Article 38 de la Loi sur la protection de la jeunesse ______________________________________________________________________ [ 1 ] Le tribunal confirme et motive, par le présent jugement, la décision rendue séance tenante lors de l'audience du 4 mai 2011, conformément aux exigences de l’article 90 de la
Loi sur la protection de la jeunesse . [ 2 ] Comme le permet Kellogg’s Company of Canada c. P.G. du Québec , [1978] C.A. 258 , 259-260, le tribunal s’est réservé le droit, au moment de rendre sa décision, d’en modifier, amplifier et remanier les motifs.
La soussignée les a remaniés pour en améliorer la présentation et la compréhension. [ 3 ] Le tribunal doit déterminer si la sécurité et le développement de X sont compromis et le cas échéant, pour quels motifs. [ 4 ] Le père admet les allégations suivantes : “3.1 as relevant background information, the child’s half-siblings were known to the Director of Youth Protection as well as the Court of Quebec, Youth Division, for issues pertaining to the parents’ drug consumption, the mother’s mental health, and inappropriate supervision as it appears more fully from the judgments filed as Exhibit D-1, en liasse; 3.2 (…)
a) the child is the subject of an Agreement on Voluntary Measures since July 19th 2010 whereby the child is entrusted to the parents’ care as it appears more fully from the said Voluntary Measures filed as Exhibit D-2;
b) the mother has another child who is not in her care as she was not providing adequately for her;
d) the mother as a longstanding history of substance consumption (ie. marijuana, speed, cocaine and crack-cocaine);
e) although the mother has participated, on several occasions, in drug rehabilitation treatments, she has successfully completed any program;
f) the father has a longstanding history of substance consumption (cocaine);
g) in 2006, the father successfully completed a drug rehabilitation treatment program, but has since relapsed;
h) more recently, the father has maintained abstinence and has tested negative to all the random drug testing;
i) at the end of October 2010, the parents went through a period of instability whereby they ended their relationship;
j) during that time, the mother left with the child and their whereabouts ere unknown for several days to the father;
k) soon after, the parents reconciled;
l) on February 5th 2011, the parents once more separated;
m) for approximately 2 weeks, the mother was not reachable;
n) the mother admits to having resumed her drug consumption;
o) the mother voices not being in a position, at this point in time, to having the child in her care;”. [ 5 ] Considérant les admissions faites par le père et la situation de l’enfant telle que décrite à la requête et aux rapports produits, le tribunal déclare que la sécurité et le développement de X sont compromis en application de l’article 38 b) 2 o de la
Loi sur la protection de la jeunesse . [ 6 ] Il est important de souligner que dans le rapport produit sous la cote D-6, à la page 2, on peut lire: “Mr. B has been consistent and reliable with his collaboration with the DYP (...).
He clearly cares deeply for X and prioritizes her best interests.” [ 7 ] Ceci confirme que l’enfant, confiée au père, sera en sécurité. [ 8 ] Il en a d’ailleurs obtenu la garde légale le 28 mars dernier, mais il devra faire clarifier le jugement puisqu’il semble que, suivant la formulation, la Directrice de la protection de la jeunesse devrait demeurer au dossier jusqu’à la majorité de l’enfant. [ 9 ] Quant à la mère, à l’automne dernier, elle est réapparue dans la vie de l’enfant et a quitté le domicile avec elle, sans informer le père de ses coordonnées. [ 10 ] Plus récemment, la mère acceptait de se présenter à une rencontre afin de participer au programme A à l’interne.
Elle ne s’y est pas présentée et est demeurée impossible à localiser pendant plus de deux semaines [ 11 ] Son instabilité et son imprévisibilité exigent que la Directrice de la protection de la jeunesse demeure au dossier pour une période assez longue. [ 12 ] Après avoir reçu les admissions, pris en considération les témoignages, les rapports produits et la position des parties, le tribunal conclut à l'existence de motifs sérieux de compromission en application de l'article 38 b) 2 o de la
Loi sur la protection de la jeunesse et estime qu'il est dans l'intérêt de l'enfant et le respect de ses droits de rendre l'ordonnance qui suit. [ 13 ] PAR CONSÉQUENT ET POUR CES MOTIFS, LE TRIBUNAL : [ 14 ] GRANTS the motion; [ 15 ] DECLARES that the security and the development of X are in danger (section 38 b) 2 o of the Youth Protection Act ); [ 16 ] ORDERS that the child remain in the care of her father, Mr. B at the exclusion of the mother; [ 17 ] ORDERS that frequency and modality of contacts between the child and her mother be determined by the Director of Youth Protection including supervision if necessary; [ 18 ] ORDERS the parents to take an active
part in the application of the measures ordered this day; [ 19 ] ORDERS the parents to submit to random drug tests requested by the Director of Youth Protection; [ 20 ] RECOMMENDS mother to take the necessary steps to deal with her mental health issues and drug dependence issues; [ 21 ] AUTHORIZES the Director of Youth Protection to speak to the mother’s treating professionals; [ 22 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to X and her family; [ 23 ] THE WHOLE for a period of one (1) year; [ 24 ] ENTRUSTS the situation of X to the Director of Youth Protection of Batshaw Youth and Family Centres, who shall then see that the measures are carried out; [ 25 ] ORDERS the execution of the present decision by any peace officer. __________________________________ DOMINIQUE WILHELMY, J.C.Q.
