N o : 525-41-013478-037 DATE : 1er octobre 2013 ______________________________________________________________________ SOUS LA PRÉSIDENCE DE : L’HONORABLE JUGE LUCIE GODIN, J.C.Q. ______________________________________________________________________ Dans la situation de l'enfant : X Née le : […] 2002 [INTERVENANTE 1] , personne autorisée par la Directrice de la protection de la jeunesse La personne déclarante -et- B -et- A Les parents mis en cause ______________________________________________________________________ JUGEMENT ______________________________________________________________________ [ 1 ] À la demande et du consentement de toutes les parties, le Tribunal procède à une enquête commune dans la situation des enfants X et Y. [ 2 ] Le Tribunal est saisi d'une requête en prolongation d'une ordonnance rendue le 15 octobre 2012 dans laquelle il déclarait que la sécurité et le développement de l'enfant demeuraient compromis et ordonnait son hébergement en centre de réadaptation dont les coordonnées devaient demeurer confidentielles, de même que certaines autres mesures visant à corriger la situation.
L'ordonnance prenait fin le 30 juin 2013. [ 3 ] La Directrice de la protection de la jeunesse allègue que la situation de l'enfant exige une prolongation d'ordonnance pour certains motifs liés à l'absence du père, au type de lien qu'entretient la mère avec son enfant et suite aux difficultés que l'enfant a vécu dans son milieu familial substitut et des conséquences qui en découlent. [ 4 ] En conséquence, la Directrice recommande au Tribunal d'ordonner le maintien de l'enfant en centre de réadaptation pour une période d'une (1) année et d'autoriser la réintégration de l'enfant en famille d'accueil si la situation le permet.
La Directrice recommande certaines autres mesures visant à répondre aux besoins de santé de l'enfant. État de compromission [ 5 ] Le père est absent à l'audience, il n'entretient aucun contact avec son enfant. [ 6 ] La mère est absente, et ce malgré que le 4 septembre 2013, le Tribunal reportait l'audience pour permettre à la mère de se présenter à la cour. [ 7 ] L'enfant, par le biais de son procureur, admet tous les paragraphes de la requête.
Par contre, elle ignore si elle a besoin d'un milieu stable qui puisse lui procurer la structure et la supervision dont elle a besoin. [ 8 ] Tenant compte des admissions formulées par l'enfant et de la preuve documentaire non contestée, le Tribunal conclut que la sécurité et le développement de l'enfant demeurent compromis et que sa situation exige une prolongation d'ordonnance pour les motifs allégués.
[ 9 ] Le Tribunal retient les éléments suivants: ➢ There have been no contacts between the child and the father; ➢ The mother maintained regular telephone contact with X until around February 2013; ➢ The mother gave birth in February 2013; ➢ The mother is said to have relocated to City A around May 2013, she has made no attempt to contact the delegate or the child since then; ➢ On April 11, 2013, Y disclosed that she had been the subject of sexual abuse at the hands of the previous foster father, D, as a result, contacts with the E Family have been suspended; ➢ The child reports that she hears voices that tell her to do bad things; ➢ The child is followed by a psychiatrist whom she meets about every six (6) weeks; she was recently diagnosed with Attention Deficit Hyperactivity Disorder and prescribed Concerta; ➢ In march 2013, an attempt was made to integrate the child in a foster family however, she reported that she was uncomfortable in the foster family and preferred to remain at E House; ➢ The child requires a stable environment, which can provide structure and supervision. [ 10 ] Concernant, les allégations d'abus sexuels exprimées par la sœur de X, Y, la situation a été évaluée et le signalement a été retenu. [ 11 ] Pour sa part, X a exprimé au Tribunal avoir été elle aussi victime d'abus sexuels de la part de monsieur D.
Le Tribunal a suspendu l'audience pour permettre à l'enfant de parler à son procureur. Au retour, l'intervenante sociale a assuré la soussignée qu'un signalement allait être fait et qu'une évaluation en conséquence allait aussi avoir lieu.
Mesures [ 12 ] L'enfant accepte les mesures recommandées par la Directrice. [ 13 ] L'avocate de la mère a affirmé que sa cliente serait toujours heureuse de recevoir sa fille et que sa porte demeurait ouverte. [ 14 ] Par ailleurs, il appert de la preuve documentaire que concernant les contacts entre la mère et l'enfant, la situation serait la suivante: «Since the last hearing in 2012-10-15 there has been some significant changes with X. Primarily, the day of the court hearing X was able to meet her biological mother Ms. B.
X prior to court had no memory of the mother and therefore, meeting her was a very anxiety provoking moment. X was interested in doing so, and asked her mother many questions. Il was granted at court that both X and her sister Y could begin to communicate with their mother with supervised phone conversations and with time eventually have a supervised visit. Since court X has not met her mother Ms. B but was able to commence supervised phone conversations as of January, 2013. The conversations were scheduled for Monday's at 5pm in which X more or less spoke to her mother for about twenty minutes.
Il was brought to the undersign's attention on 2013-03-22, that Ms. B had left City B without any prior notification and was presently residing in City A with her family. The undersigned tried contacting Ms. B via her cellular phone however, the phone line was disconnected. To date there has been no contact between Ms. B, and X. X was disappointment in learning that her mother had left City B, as she had just begun establishing a relationship with her however, after a few weeks X did not ask any further questions about Ms.
B and continued her usual routine». [1] [ 15 ] Concernant l'intervention de la Directrice et l'orientation recherchée, les éléments suivants apparaissent à la page 5 du même rapport: «On going DYP involvement is needed to further assist X with controlling her defiant behaviours and helping her learn new strategies and ways to act appropriately in high stress situations. X can also benefit from emotional and social support as she will eventually be integrating into a new foster home in the future.
The goal is to provide X with she skills needed to address her difficulties in order for her to feel secure and ready to transition into foster care without much fear as she presented during this review period.
Given that both of X's biological parents have no contact with her, and her only family support is her sister, X will benefit on going aid, counsel and assistance until the age of majority.» [2] [ 16 ] Les objectifs recherchés par les recommandations sont les suivants: «The goal is to have X eventually integrate into a foster family and continue to help her find strategies and coping mechanisms to deal with her defiant behaviours.» [3] [ 17 ] Tenant compte du consentement de l'enfant et de la preuve documentaire non contestée, le Tribunal conclut que les recommandations sont dans l'intérêt de l'enfant. [ 18 ] PAR CES MOTIFS, LE TRIBUNAL : [ 19 ] GRANTS the motion;
[ 20 ] EXTENDS the decisions that were rendered on October 15, 2012; [ 21 ] ORDERS that X remain in a rehabilitation center for a period of one (1) year as of today; [ 22 ] AUTHORIZES X's integration into a foster home if the situation allows; [ 23 ] ORDERS that X to participate in psychological counselling; [ 24 ] ORDERS X continue to receive the needed medical support from the A Hospital; [ 25 ] ORDERS that contacts between X and her sister Y be encouraged; [ 26 ] ORDERS that Director of Youth Protection determine the frequency and modality of contacts between X and her mother, taking into consideration the child's best interest and her wishes; [ 27 ] WITHDRAWS from the parents the attributes of parental authority with respect to signing all consents for X related to health, travel, passports, school, activities, etc; [ 28 ] AUTHORIZES the Director of Youth Protection to sign all consents for X related to health, travel, passports, school, activities, etc; [ 29 ] PROHIBITS any type of contacts between X and her father; [ 30 ] ORDERS that aid, counsel and assistance be provided to X and her family for a period of one (1) year as of today; [ 31 ] ENTRUSTS the situation of X C to the Director of Youth Protection for the execution of the present judgment. __________________________________ LUCIE GODIN, J.C.Q.
