[ 2 ] The mother of the child is deceased as it appears at the death certificate of the mother filed as exhibit D-3. [ 3 ] The child has no paternal filiation. [ 4 ] The child is an orphan who is a minor and does not have a dative tutor. [ 5 ] The child is the subject of a judgment of the Court of Quebec and the Youth Protection intervenes in his life.

[ 6 ] The child’s situation has been entrusted to the Director of Youth Protection for the execution of the judgment filed as exhibit D- 4. [ 7 ] The Director also filed a tutorship report in the situation of the child under exhibit D-5. [ 8 ] Considering the whole evidence, the assessment of the situation by the Director of Youth Protection, the Court comes to the conclusion that the application is well founded in facts and in law.

THEREFORE, THE COURT: [ 9 ] GRANTS the application; [ 10 ] APPOINTS the Executive Director of Youth Protection A – Child and Youth Protection Centre (C.Y.P.C.) as a tutor for the child; [ 11 ] ENTRUSTS the child to the Director of Youth Protection A C.Y.P.C.; [ 12 ] ORDERS the execution of the present judgment notwithstanding appeal . ___________________________________ LUCIE GODIN, J.C.Q.
