Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). ______________________________________________________________________ [ 1 ] The present judgment confirms in writing the decision rendered orally at the hearing held on April 12, 2019 [ 2 ] La Directrice de la protection de la jeunesse (la Directrice) demande au Tribunal de confier X à la mère et Y au père et d’ordonner un suivi social pour une période de quatre (4) mois. [ 3 ] Les enfants, par la voix de leur avocat, sont en accord avec les mesures proposées. [ 4 ] Les parents font certaines admissions et sont en accord avec les mesures proposées.
Ils mentionnent que leur communication s’est améliorée et qu’ils arrivent à prioriser les besoins des enfants. CONTEXT [ 5 ] Lors de la dernière audition, le Tribunal ordonne des mesures intérimaires afin que les parents puissent faire leurs démarches à la Cour supérieure en lien avec la garde des enfants. [ 6 ] Les parents n’ont pas complété leurs démarches, toutefois la situation continue à bien évoluer. [ 7 ] La communication entre les parents s’améliore.
Ils acceptent de mettre en place des stratégies afin de pouvoir voir aux besoins de leurs filles. [ 8 ] La mère fait preuve d’ouverture et de flexibilité dans sa relation avec Y. L’enfant exprime être satisfaite des contacts actuels. Elle évolue bien auprès de son père.
[ 9 ] Au plan scolaire, l’enfant a de bons résultats académiques et a un bon comportement en classe et avec ses camarades. [ 10 ] La situation est plus difficile pour X, elle adopte des comportements d’opposition. Elle a eu en sa possession à quelques reprises de la marijuana et elle est en échec scolaire dans plusieurs matières. [ 11 ] Les parents travaillent de concert afin d’être cohérents, constants et au diapason auprès de l’adolescente.
La situation n’est pas toujours facile et la présence de la Directrice est aidante. [ 12 ] Si la situation se maintient, l’objectif de la Directrice est de se retirer de la vie de la famille. [ 13 ] Le Tribunal estime que les mesures proposées sont dans le meilleur intérêt et le respect des droits des enfants. CONSEQUENTLY, AND FOR THESE REASONS, THE COURT: [ 14 ] GRANTS the Application; [ 15 ] DECLARES that the security and development of the children continue to be endangered within the meaning of the Youth Protection Act ; AND IN VIRTUE OF THE POWERS CONFERRED UPON THE COURT BY
SECTION 91 OF THE YOUTH PROTECTION ACT: [ 16 ] ENTRUSTS X to her mother; [ 17 ] ORDERS that the frequency and modality of contacts between X and her father be upon agreement by all the parties; [ 18 ] RECOMMENDS that the mother address her personal issues and report to the Director of Youth Protection as to her progress; [ 19 ] RECOMMENDS that the parents resolve their financial and custody issue through Superior Court; [ 20 ] AUTHORIZES the Director of Youth Protection to exchange pertinent information with treating professionals; [ 21 ] ORDERS that the mother and the child participate in a program that focuses on parenting and communication between parent and child; [ 22 ] RECOMMENDS that the child participate in therapy for as long as deemed necessary; [ 23 ] ORDERS that aid, counsel and assistance be provided to the child and her family; [ 24 ] ENTRUSTS the situation of the X, to the Director of Youth Protection of CIUSSS A, who shall then see that the measures are carried out and these measures may be executed by any peace officer if necessary; [ 25 ] THE WHOLE for a period of four (4) months.
