The following is the judgment delivered by THE COURT (Orally) [ 1 ] On October 11, 2013, following a trial in the Provincial Court, Michael David Johnston was convicted of break and enter into a dwelling and committing therein an indictable assault ( s. 348(1) (
b) of the Criminal Code ). On November 13, 2013, he was sentenced to 40 months in jail. Mr. Johnston filed a Notice of Appeal against conviction and sentence, in which he expressed the wish to present his case and argument in person. The hearing of his appeal against conviction and application for leave to appeal sentence is scheduled for today. Mr. Johnston is not present. [ 2 ] The Registrar confirms every reasonable effort was made to contact Mr. Johnston with a view to informing him of the date for the hearing, but to no avail. Moreover, the Registrar advises Mr.
Johnston has never contacted her office to ascertain the hearing date. [ 3 ] Rule 63.23(1) (“Failure to Appear at Hearing of Appeal”) reads as follows: 63.23(1) If an appellant who has not stated in his Notice of Appeal his intention not to appear personally or by counsel fails to appear at the hearing of the appeal, the Court of Appeal may adjourn the hearing, dismiss the appeal or may hear it in the appellant’s absence.
[ 4 ] An appellant is duty bound to take steps to ascertain the date and time for the hearing of his or her appeal. [ 5 ] In light of the above, Mr. Johnston’s appeal against conviction and his application for leave to appeal sentence are dismissed, but without prejudice to his right to apply to a panel of this Court for reinstatement upon good cause being shown.
[3] Voici le libellé de la règle 63.23(1) (« Défaut de comparaître à l’audition de l’appel ») : 63.23(1) If an appellant who has not stated in his Notice of Appeal his intention not to appear personally or by counsel fails to appear at the hearing of the appeal, the Court of Appeal may adjourn the hearing, dismiss the appeal or may hear it in the appellant’s absence.
