BRAULT & MARTINEAU INC. 16975 Route Transcanadienne Kirkland Québec H9H 5J1 Défendeur ______________________________________________________________________ JUDGMENT ______________________________________________________________________ [ 1 ] Considering that Plaintiff, Humberto Galis, instituted an action against Defendant, Brault & Martineau, for $963,90, claiming that the television model Sony Bravia KDL 32S5100 that he bought from Defendant on October 9, 2009, is defective; [ 2 ] Considering that Defendant requested that Plaintiff contact its service centre to determine whether the problem stemmed from the said television or was related to Plaintiff's computer, when connected to the television; [ 3 ] Considering that Plaintiff failed to contact Defendant's service centre; [ 4 ] Considering that the Court required that Plaintiff make arrangements with Defendant to have a technician verify both the television and the computer connection, to determine the source of the problem; [ 5 ] Considering that Plaintiff refused Defendant's offer to make such arrangements; [ 6 ] Considering that Plaintiff advised the Court that he has since sold his television; [ 7 ] Considering that the issue in dispute is moot and Plaintiff is no longer interested in pursuing his action; FOR THESE REASONS, THE COURT: DISMISSES the action of Humberto Galis.
