Mélahelle Sicotte, Clerk at the hearing JUDGMENT [ 1 ] The Applicant seeks leave to appeal the judgment rendered on March 10, 2020 by the Superior Court, District of Montreal (the Honourable Marie-Christine Hivon), in the course of the proceedings.
The main proceeding is the Respondent’s “ Demande en remplacement des curateurs à la personne et aux biens à une majeure et convocation d’une assemblée de parents, d’alliés ou d’amis en ordonnance pour réévaluation médicale et psychosociale et en ordonnance de sauvegarde pour suspendre toute procédure en cours et en interdire de nouvelles concernant une majeure protégée ou ses représentants légaux et nommer un administrateur provisoire à la personne et aux biens ”. [ 2 ] The judgment concludes as follows : [40] DÉCLARE que le Jugement Jacques a révisé le jugement du juge Silcoff du 8 octobre 2015 relativement à tous les aspects concernant le régime de protection de Ru… Kr…; [41] DÉCLARE que dans l’attente d’un jugement final, le Jugement Jacques est le seul jugement applicable au régime de supervision de Ru… Kr…; [42] DÉCLARE que le défendeur, S… M…, n’a pas d’intérêt légal pour poursuivre personnellement quelque processus d’arbitrage fondé sur l’entente homologuée par le Jugement Silcoff relativement aux droits, intérêts et propriétés de Ru… Kr…; [43] DÉCLARE que le défendeur, S… M…, n’a pas l’intérêt légal pour intenter quelque action en justice au nom de Ru… Kr… ni exercer les droits civils de cette dernière, incluant toute action en dommage ou relative à sa propriété; [44] LE TOUT , frais de justice à suivre le jugement final. [ 3 ] By way of background, it is relevant to note that on June 8, 2018, the Honourable Denis Jacques, J.S.C., ordered the replacement of Da.
R., curator to the property of the Applicant’s mother and named the Respondent, Public Curator provisionally, as curator (the “Jacques Judgment”). [ 4 ] The Applicant has taken the position that the Jacques Judgment is not controlling and a previous judgment rendered by Justice Silcoff on October 8, 2015 homologating an agreement between him and his sister (the impleaded party R.
K.) is controlling. [ 5 ] It is this position which gave rise to the Respondent’s motion in the lower Court, the appeal of the judgment disposing of which is before me. [ 6 ] After service but prior to presentation of the application, judgment on the merits was rendered by the special clerk of the Superior Court on July 6, 2020 who ordered that the Respondent should continue as curator to the person of Ru. Kr. and named La Société Canada Trust as curator to her property.
Applicant insists that he will seek revision of this judgment before a judge so that the judgment is not final and the present proceeding is not moot. [ 7 ] Leave to appeal the Hivon Judgment is subject to
article 31 C.C.P. :
31. A judgment of the Superior Court or the Court of Québec rendered in the course of a proceeding, including during a trial, is appealable as of right if it disallows an objection to evidence based on the duty of discretion of public servants, on professional secrecy or on the protection of the confidentiality of a journalistic source. 31.
Le jugement de la Cour supérieure ou de la Cour du Québec rendu en cours d’instance, y compris pendant l’instruction, peut faire l’objet d’un appel de plein droit s’il rejette une objection à la preuve fondée sur le devoir de discrétion du fonctionnaire de l’État, sur le respect du secret professionnel ou sur la protection de la confidentialité d’une source journalistique. Such a judgment may be appealed with leave of a judge of the Court of Appeal if the judge considers that it determines part of the dispute or causes irremediable injury to a party, including if it allows an objection to evidence .
Il peut également faire l’objet d’un appel sur permission d’un juge de la Cour d’appel, si ce dernier estime que ce jugement décide en
partie du litige ou cause un préjudice irrémédiable à une partie, y compris s’il accueille une objection à la preuve. (…) […] (Emphasis added) [ 8 ] While the Applicant alleges many errors in the judgment, the criteria of
article 31 C.C.P. are not addressed in the application. Clearly, any prejudice caused can be remedied by final judgment and there is no indication that the issues on the merits have been decided in the Hivon Judgment. [ 9 ] FOR ALL THE FOREGOING REASONS, THE UNDERSIGNED : [ 10 ] DISMISSES the Application for leave to appeal from a judgment rendered in the course of the proceedings, with legal costs.
