Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents.
Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). [ 1 ] La Directrice de la protection de la jeunesse demande au Tribunal d’ordonner l’hébergement en famille d’accueil pour une période de 6 mois de quatre (4) enfants d’une même famille. [ 2 ] La mère des quatre (4) enfants et le père de la cadette Y sont présents. [ 3 ] Les parties ont accepté de procéder à une enquête commune même si les trois (3) autres enfants sont d’un père différent. Celui- ci est décédé il y a quelques années. [ 4 ] Conformément aux dispositions de l’article 76.3 de la
Loi sur la protection de la jeunesse , les parties assistées de leur avocat ont soumis au Tribunal un projet d’entente dans lequel elles reconnaissent les faits démontrant que la sécurité et le développement des enfants sont compromis et conviennent de mesures de protection visant à mettre fin à la situation. [ 5 ] Le consentement des parties est libre et éclairé. [ 6 ] Les rapports déposés à l’audience indiquent que les enfants Z, A et X font l’objet de mesures volontaires de protection depuis juin 2017.
L’enfant Y fait l’objet d’une ordonnance en protection depuis le 2 novembre 2018. [ 7 ] La mère vivait alors avec son conjoint D, père de l’enfant Y. [ 8 ] Les mesures de protection ont été mises en place parce que les enfants étaient exposés aux actes de violence de monsieur D envers leur mère. L’enfant A a également été victime de violence de la part de M.
D. [ 9 ] La preuve révèle également que les enfants étaient victimes de négligence sur le plan éducatif et exposés à un risque d’abus physique par le conjoint de la mère. [ 10 ] La mère présente un problème de consommation d’alcool qui affecte sa capacité parentale [ 11 ] Les mesures concernant les 4 enfants prévoyaient qu’ils demeuraient dans le milieu familial de leur mère à l’exclusion de M. D. [ 12 ]
Malgré l’engagement de la mère de ne pas mettre les enfants en contact avec monsieur D, ils ont été en sa présence à plusieurs reprises. [ 13 ] En novembre dernier, le fils aîné de la mère, X, âgé de neuf (9) ans a dû appeler le 911 parce que sa mère s’était évanouie en
raison de son état d’ébriété avancé et sa jeune sœur Y était tombée du lit. [ 14 ] Suite à cet évènement, les quatre (4) enfants ont été retirés du milieu familial de la mère pour être hébergés dans des familles d’accueil. [ 15 ] Il semble que la mère a maintenu sa relation avec monsieur D depuis l’ordonnance provisoire et qu’elle a tendance à privilégier sa relation au détriment de ses responsabilités parentales. [ 16 ] La mère et monsieur D doivent comprendre que leur collaboration est essentielle pour permettre un retour des enfants dans le milieu familial. [ 17 ] La mère est issue d’une communauté [A].
Elle vivait à Ville A jusqu’en 2016. Sa langue seconde est l’anglais. Les rapports produits de même que les projets d’entente ont été traduit en anglais de manière à ce que la mère puisse prendre position en toute connaissance de cause. [ 18 ] Le jugement écrit sera également remis aux parties avec une version anglaise. POUR CES MOTIFS, LE TRIBUNAL : [ 19 ] ACCUEILLE la demande; [ 20 ] DÉCLARE la sécurité et le développement de x compromis; [ 21 ] ENTÉRINE le projet d’entente signée à Ville B le 18 janvier 2019 par les parties et annexée au présent jugement pour en faire
partie intégrante; [ 22 ] ORDONNE l’exécution des mesures de protection qui y apparaissent; [ 23 ] ORDONNE aux personnes visées de s’y conformer; [ 24 ] CONFIE la situation de l’enfant à la Directrice de la protection de la jeunesse pour l’exécution de l’ordonnance. In the situation of: X born on the [...], 2009 [SOCIAL WORKER 1], person authorized by the Director of Youth Protection A Petitioner and B Mother ______________________________________________________________________ JUDGMENT RECTIFIED ______________________________________________________________________ WARNING: The Youth Protection Act forbids the publishing or broadcasting of information allowing for a child or the child’s parents to be identified.
Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [1] The Director of Youth Protection asks the Tribunal to order that four (4) children from the same family be entrusted to a foster home for a period of 6 months. [2] The mother of the four (4) children and the father of the youngest child Y are present. [3] The parties agreed to conduct a joint hearing even though the other three (3) children are from a different father who has deceased a few years ago. [4] In accordance with the provisions of
section 76.3 of the Youth Protection Act , the parties have submitted to the Tribunal a draft agreement in which they acknowledge the facts demonstrating that the safety and development of the children are being compromised and agree on the proposed measures to correct the situation. [5] The consent of the parties is free and voluntary. [6] The reports filed at the hearing indicate that Z, A and X are under voluntary protection measures since June 2017. Y is subjected to protective measures ordered by the court since November 2, 2018. [7] The mother was living with Mr.
C, father of Y. [8] The protective measures were put in place because the children were exposed to acts of violence by Mr. C against their mother. A was also a victim of violence by Mr. C. [9] The evidence also reveals that the children were neglected on the educational level and exposed to the risk of physical abuse by Mr. C. [10] The measures concerning the four children provided that they remain with their mother at the exclusion of Mr. C. [11] The mother has a drinking problem that affects her parenting ability. [12] Despite the mother's commitment not to put her children in contact with Mr.
C, they have been in his presence several times. [13] Last November, the eldest son, X had to call the 911 emergency services because his mother had fainted due to her drunkenness and her younger sister Y had fallen from the bed. [14] Following those events, the four (4) children were removed from the mother's family home and have been entrusted to a foster home in accordance with an interim court order. [15] It seems that the mother has maintained her relationship with Mr.
C since the interim order and that she tends to favour her relationship to the detriment of her parental responsibilities. [16] The mother and Mr. C must understand that their collaboration is essential to allow the eventual return of the children in their family home. [17] The mother is from community A. She lived in Town A until 2016. Her second language is English. The reports produced as well as the agreements have been drafted in English and French so that the mother can take an informed position. [18] The written judgment will also be delivered to the parties with an English translation.
THEREFORE, THE TRIBUNAL: [19] GRANTS the motion; [20] DECLARES that the security and development of X are in danger according to the Youth Protection Act; [21] ENDORSES the draft agreement signed in Town B J anuary 18, 2019, by the parties and annexed to this judgment to be an integral part; [22] ORDERS the execution of the protective measures that appear in the agreement; [23] ORDERS the persons concerned to comply with it; [24] ENTRUST the situation of X to the Director of Youth Protection for the execution of the order.
