Article 95 de la Loi sur la protection de la jeunesse ______________________________________________________________________ [ 1 ] Le tribunal confirme et motive, par le présent jugement, la décision rendue séance tenante lors de l'audience du 20 février 2013, conformément aux exigences de l’article 90 de la
Loi sur la protection de la jeunesse . [ 2 ] Comme le permet Kellogg’s Company of Canada c. P.G. du Québec , [1978] C.A. 258 , 259-260, le tribunal s’est réservé le droit, au moment de rendre sa décision, d’en modifier, amplifier et remanier les motifs.
La soussignée les a remaniés pour en améliorer la présentation et la compréhension. [ 3 ] Le tribunal doit déterminer s’il est dans l'intérêt de X de prolonger la décision rendue le 4 juillet 2012. [ 4 ] À cette date, le tribunal confie l’enfant en centre de réadaptation et impose d’autres mesures ayant pour but de mettre fin à la situation de compromission. [ 5 ] La mère et l’enfant admettent les allégations suivantes : « 3.1 the child remained in [A Center] where he is doing well; 3.2. the mother has continued to make gains and maintained her sobriety; 3.4 the child received therapy for six (6) months; unfortunately, he did not invest in the process as a result, his therapy was suspended; 3.8 the child is doing well in school and would benefit from stability in his current school setting until the end of the school year; ». [ 6 ] X voudrait retourner chez sa mère dès aujourd’hui, mais le tribunal doit s’assurer que le retour dans le milieu familial sera un succès.
La reprise de la thérapie pourrait accélérer ce retour, mais encore faut-il que l’adolescent y consente, s’implique et participe. [ 7 ] La stabilité de l’adolescent en centre de réadaptation favorise la fréquentation scolaire régulière, et il doit mettre à profit l’aide qu’il est en mesure de recevoir des éducateurs. [ 8 ] La mère a accompli de grand progrès; elle s’est mise en action, a répondu aux demandes des intervenants et a convenablement et de façon profitable pour elle et son fils participé à l’intervention sociale et c’est tout à son honneur. [ 9 ] Après avoir reçu les admissions, pris en considération la position des parties et la preuve testimoniale et documentaire, le tribunal estime que les faits prouvés et admis permettent la prolongation de l'ordonnance rendue le 4 juillet 2012 et qu'il est dans l'intérêt de l'enfant et le respect de ses droits de rendre l'ordonnance qui suit.
[ 10 ] PAR CONSÉQUENT ET POUR CES MOTIFS, LE TRIBUNAL : [ 11 ] GRANTS the motion; [ 12 ] DECLARES that the security and the development of X are still in danger; [ 13 ] EXTENDS the order rendered on July 4, 2012; [ 14 ] ORDERS that the child be entrusted to a rehabilitation centre; [ 15 ] ORDERS the Director of Youth Protection to begin from now on the progressive reintegration of X with his mother and to continue to do so, as long as the situation is still positive and the best interests of the child requires it; [ 16 ] ORDERS that frequency and modality of contacts between the child and his father be determined by the Director of Youth Protection and that they be supervised as long as necessary; [ 17 ] ORDERS the Director of Youth Protection to encourage contacts between the child, his siblings and his parents; [ 18 ] ORDERS father to continue with treatment regarding his substance abuse and conjugal violence; [ 19 ] ORDERS mother, given her agreement, to submit to random drug and alcohol testing; [ 20 ] RECOMMENDS father to submit to random drug and alcohol testing; [ 21 ] STRONGLY RECOMMENDS that X participates in a therapeutic treatment; [ 22 ] ORDERS the Director of Youth Protection, as soon as X asks for a therapeutic treatment, to put the treatment in place within two (2) weeks from the request and ORDERS the Director of Youth Protection to turn to the private sector if the public sector cannot offer the service within the time limit allowed; [ 23 ] ORDERS the Director of Youth Protection to ensure that the services of a reintegration educator be accessible to the family during the whole period of the order; [ 24 ] STRONGLY RECOMMENDS that the adolescent remains entrusted to the [A Center]; [ 25 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to X and his family; [ 26 ] THE WHOLE until June 30, 2013; [ 27 ] ENTRUSTS the situation of X to the Director of Youth Protection A, who shall then see that the measures are carried out; [ 28 ] This decision is enforceable from the moment it is made and any person referred to therein shall comply forthwith and notwithstanding an appeal ( Articles 93 and 105 of the Youth Protection Act ). __________________________________ DOMINIQUE WILHELMY, J.C.Q.
