[ 1 ] Le Tribunal est saisi d'une demande en révision d’une ordonnance rendue par le soussigné le 14 mai 2018. [ 2 ] Le Directeur recommande la poursuite du placement des enfants chez leur grand-père maternel jusqu’à leur majorité La mère consent.
Le père est absent. [ 3 ] L’évaluation psychiatrique de la mère fait état d’une légère déficience intellectuelle. Sa capacité d’empathie est limitée. Elle n’est pas apte à assumer la responsabilité de ses enfants. [ 4 ] Quant au père, son implication est sporadique. Il peut passer plusieurs mois sans contact avec ses enfants pour les reprendre par la suite. [ 5 ] Au moment de l’audition, ni l’un ni l’autre des parents n’a vu les enfants depuis le début du mois d’août. [ 6 ] Par ailleurs, les enfants sont bien chez leur grand-père. Le lien affectif est fort et réciproque.
Il n’y a pas lieu de modifier ces conditions de vie. Le grand-père et sa conjointe s’engagent à assumer la responsabilité des enfants jusqu’à leur majorité respective. [ 7 ] Quant à l’exercice de certains attributs de l’autorité parentale, on notera que vu l’inconsistance des parents et la nécessité pour les enfants de recevoir des soins de santé et d’être inscrits à l’école dans un court délai, il y a lieu de les confier au grand-père.
FOR ALL THESE REASONS, THE COURT: [ 8 ] DECLARES that security and development of X and Y are still compromised; [ 9 ] ENTRUSTS the situation of the children to the Director of Youth Protection of Director of Youth Protection of the CIUSS A, who shall then see that the measures are carried out: [ 10 ] ENTRUSTS the children to the specific foster home of C and D;
[ 11 ] ORDERS that contacts between the children and their mother take place following modalities to be established by the Director at a frequency to be agreed upon between the mother and the Director, failing an agreement the contacts will take place once every 2 weeks; [ 12 ] ORDERS that contacts between the children and their father take place following modalities to be established by the Director at a frequency to be agreed upon between the Director and the father, failing an agreement the contacts will take place once a month; [ 13 ] ORDERS the parents to collaborate with the Director of Youth Protection; [ 14 ] WITHDRAWS the exercise of certain attributes of the parent’s authority to grant it to C in regards to health care and school issues; [ 15 ] RECOMMENDS that the parents continue to receive therapeutic support; [ 16 ] ORDERS that aid, counsel and assistance be provided to the children and their parents; [ 17 ] THE WHOLE until their respective majority.
