_____________________________ Kathleen A. Quigg, j.c.a. English version of the judgment delivered by THE COURT (Orally) [1] On July 2, 2015, at the conclusion of a trial in Provincial Court, Gilles Joseph Chagnon was convicted of sexual assault. Mr. Chagnon appeals the conviction on several grounds. In particular, he contends [TRANSLATION] “[t]he trial judge erred in law in failing to deliver meaningful reasons for his decision”. [2] The parties to this appeal recognize the jurisprudential principles established in R. v. Sheppard , 2002 SCC 26 , [2002] 1 S.C.R. 869 , and its progeny.
According to these principles, “[a]n appeal based on insufficient reasons will only be allowed where the trial judge’s reasons are so deficient that they foreclose meaningful appellate review”: R. v. Dinardo , 2008 SCC 24 , [2008] 1 S.C.R. 788 , at para. 25 . [3] Mr. Chagnon contends the trial judge did not provide sufficient reasons, when rendering his decision, to permit appellate review. The Attorney General of New Brunswick recognizes this ground of appeal has merit. He agrees the judge’s reasons [TRANSLATION] “are deficient to the point of foreclosing meaningful appellate review”.
Therefore, the Attorney General concedes the appeal. [4] Given the concession of the Attorney General, we would allow the appeal. [5] For these reasons, the appeal is allowed, the conviction is set aside, and a new trial is ordered.
