Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents. Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). [ 1 ] Le Tribunal est saisi d'une requête concernant X, âgé de 14 ans.
La Directrice de la protection de la jeunesse demande de déclarer compromis sa sécurité et son développement au sens de l'article 38 b) 1) iii) : négligence au plan éducatif et 38 f) : troubles de comportement. [ 2 ] La Directrice allègue que la situation de cet enfant a fait l'objet de deux ententes sur des mesures volontaires à compter du 26 novembre 2013. À l'époque, l'enfant demeure chez sa mère. Il est violent verbalement et physiquement à l'encontre de sa mère et sa fratrie.
Il cumule les absences au plan scolaire. [ 3 ] La mère éprouve de la difficulté à dispenser un encadrement cohérent et constant à son fils, ce dernier notamment se couche très tard. Il est donc incapable de se lever le matin d'où ses absences répétitives à l'école. Il passe plusieurs heures à jouer sur son x-box. [ 4 ] La mère est consciente de ce problème mais refuse par ailleurs de sortir la console de jeux de la chambre de son fils. [ 5 ] L'enfant ne prend sa médication de façon régulière afin de contrer son TDAH. Il refuse de la prendre compte tenu des effets secondaires.
Il énonce qu'il est en quelque sorte déprimé lorsqu'il prend cette médication. [ 6 ] En octobre 2013, l'enfant séjourne un mois au foyer de groupe BMAYS . La mère demande par la suite qu'il réintègre son domicile. La mère s'est vite retrouvée dépassée demandant qu'il soit à nouveau déplacé de chez elle. [ 7 ] Au mois de février 2014, l'enfant intègre une fois de plus le foyer de groupe.
Malgré son intégration au centre, l'enfant refuse de prendre sa médication. Il s'absente de l'école et peut être violent verbalement. [ 8 ] Des rencontres afin de définir les attentes de la mère et de l'adolescent ont eu lieu. Plusieurs contrats concernant le respect de diverses règles furent mis de l'avant. Celles-ci n'ont pas été respectées par les parties, la mère omettant d'appliquer les conséquences lorsque son fils transgressait lesdites règles. [ 9 ] Depuis lors, la mère a posé ses exigences.
Elle demande à son fils de prendre sa médication régulièrement, de fréquenter l'école de façon assidue, de respecter l'heure du coucher afin d'être en mesure de se lever tôt le matin, conditions essentielles à ce qu'elle
accepte, dit-elle, un retour de son fils dans le milieu familial. [ 10 ] Depuis le mois de juin, l'adolescent prend sa médication. L'entourage le constate d'emblée. Il est un adolescent poli qui adopte de bons comportements lorsqu'il prend sa médication. À défaut, il devient fébrile. [ 11 ] Madame [intervenante 2], travailleuse sociale, qui assure le suivi psychosocial, dépeint les comportements de l'enfant lorsqu'il omet de prendre sa médication.
Elle dit: When he does not, he is all over the place, fools around a lot, annoys others (ex: he will act like a 4-year-old, will start a small fight to tease, poke others, give little taps on the arm to annoy others) and will not know when to stop. He also needs more closure, will hug and play in the hair of staff members even if it is not allowed. He can also bite the staff and swear. [1] [ 12 ] La disponibilité de la mère est un autre aspect dont il faut tenir compte. La mère travaille sur des horaires variables. Elle est présentement sur une cédule de nuit.
La mère étant monoparentale s'occupe seule de ses trois enfants. Il devient parfois difficile de la rejoindre. [ 13 ] La mère reconnaît qu'elle fut par le passé très permissive laissant X faire ce qu'il voulait et elle acquiesçait à ses demandes. Depuis un an, elle tente toutefois d'imposer certaines limites. Elle trouve cependant encore difficile de demeurer ferme sur sa position et éviter de céder lorsqu'elle est confrontée aux jérémiades de ses enfants. [ 14 ] La mère est consciente qu'elle se doit d'être davantage cohérente et constante quant à l'encadrement à mettre en place à l'égard de X.
Toutefois, elle compte grandement sur la capacité de son fils de s'autodiscipliner. [ 15 ] La mère devra comprendre que son fils est encore un jeune adolescent qui nécessite d'être guidé et soutenu dans ses choix. [ 16 ] La Directrice de la protection de la jeunesse requiert le maintien de cet adolescent en centre de réadaptation jusqu'au 31 décembre prochain. Elle souhaite, par le biais des sorties de fins de semaine, des congés scolaires et autres, augmenter progressivement les séjours de l'adolescent dans le milieu familial et compléter la réintégration d'ici la fin du mois de décembre.
Elle souhaite de plus dispenser des services auprès de la famille jusqu'au 30 juin 2016. [ 17 ] La mère accepte les mesures recherchées. [ 18 ] Les progrès constatés depuis le mois de juin dernier au niveau des attitudes de l'adolescent sont prometteurs.
La rentrée scolaire présentera toutefois un défi de taille d'où l'importance de procéder par étapes afin de maximiser les chances de succès de cette réintégration familiale. [ 19 ] Les mesures proposées sont dans l'intérêt de l'adolescent. [ 20 ] POUR CES MOTIFS, LE TRIBUNAL: [ 21 ] GRANTS the motion; [ 22 ] DECLARES that the security and the development of the child X are in danger for the following reasons: ― 38 b) 1) iii) neglect on educational level; ― 38 f) : serious behavioural disturbance; [ 23 ] ORDERS that the child X be entrusted to an institution operating a rehabilitation centre chosen by Director of Youth Protection A until December 31, 2015; [ 24 ] ORDERS that the child X be entrusted to his mother from December 31, 2015 and that the mother and the child report periodically to the Director of Youth Protection on the measures they apply to put an end at the situation in which the security or development of the child is in danger; [ 25 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to the child X and his family until June 30, 2016; [ 26 ] ORDERS that the child X and his mother take an active
part in the application of the measures ordered; [ 27 ] ORDERS that the child X attend a school until June 30, 2016; [ 28 ] ORDERS that the child X receive certain health care and health services, among other things, to take his prescribed medication; [ 29 ] ENTRUSTS the situation of the child X to the Director of Youth Protection A for the execution of the present judgment. __________________________________ JOHANNE DENIS, J.C.Q. Every person who contravenes this provision is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [1] The Court is seized of a motion regarding X, 14 years old. The Director of Youth Protection has asked that his security and development be declared in danger under
section 38( b )(1)(iii): neglect from an educational standpoint, and 38( f ): behavioural disturbances. [2] The Director alleged that the child’s situation was the subject of two agreements on voluntary measures that began on November 26, 2013. At that time, the child was living with his mother. He was verbally and physically violent toward his mother and siblings. He had accumulated absences from school. [3] The mother had difficulty providing consistent and continuous supervision for her son; in particular, he went to bed very late.
As a result, he was unable to get up in the morning; hence his repeated absences from school. He spent numerous hours playing on his X-box. [4] The mother was aware of the problem, but refused to remove the game console from her son’s room.
[5] The child was not taking his medication for his ADHD regularly. He refused to take it because of the side effects. He stated that he felt sort of depressed when he took the medication. [6] In October 2013, the child stayed at the BMAYS group home for one month. The mother subsequently asked that he return to her home. The mother quickly found herself overwhelmed, and again asked that he be removed from her home. [7] In February 2014, the child once again integrated into the group home. Despite his integration into the centre, the child refused to take his medication.
He missed school and was sometimes verbally violent. [8] Meetings were held to establish the expectations of the mother and the adolescent. A number of contracts involving compliance with various rules were implemented, but the parties did not comply with them. The mother failed to apply the consequences when her son violated the rules. [9] Since then, the mother has imposed her conditions.
She is demanding that her son take his medication regularly, attend school regularly, and comply with his bedtime so he is able to get up early in the morning, conditions she says are essential for her to agree to her son’s return to the family environment. [10] Since June, the adolescent is taking his medication. Those around him can see it right away. He is a polite adolescent who behaves well when he takes his medication. He becomes agitated when he does not. [11] [intervenante 2], social worker who ensures psychosocial follow-up, described the child’s behaviour when he neglects to take his medication.
She said: When he does not, he is all over the place, fools around a lot, annoys others (ex: he will act like a 4-year-old, will start a small fight to tease, poke others, give little taps on the arm to annoy others) and will not know when to stop. He also needs more closure, will hug and play in the hair of staff members even if it is not allowed. He can also bite the staff and swear. [2] [12] The mother’s availability is another factor that must be taken into account. The mother works flexible shifts. She is currently working nights. The mother is a single parent who cares for her three children alone.
Sometimes it is difficult to get in touch with her. [13] The mother acknowledges that she was very permissive in the past, allowing X to do as he wanted and giving in to his demands. However, she has been trying to set certain limits for a year. But she still finds it difficult to maintain her position firmly and avoid giving in when she is faced with her children’s whining. [14] The mother is aware that she must be more consistent and continuous with the supervision in place for X.
However, she relies heavily on her son’s ability to discipline himself. [15] The mother must understand that her son is still a young adolescent who requires guidance and support for his choices. [16] The Director of Youth Protection is asking that the adolescent remain at a rehabilitation centre until December 31, 2015. She wants to progressively increase the adolescent’s stays in the family environment by means of weekend outings, school holidays and others, and complete the reintegration by the end of December.
Additionally, she wants to provide services to the family until June 30, 2016. [17] The mother agreed with the measures sought. [18] The progress seen in the adolescent’s attitudes since last June is promising.
However his return to school will represent a significant challenge, hence the importance of proceeding by steps in order to maximize the chances of a successful family reintegration. [19] The measures proposed are in the adolescent’s interest.
