Elisabeth Lepage , Greffière-audiencière JUGEMENT [ 1 ] Je suis saisie d'une requête présentée par l'intimée en vertu de l' article 685 (1) du Code criminel (ci-après C.cr .), pour renvoi de l'appel devant une formation de la Cour en vue d'une décision
sommaire. [ 2 ] Les appelants sont accusés des chefs suivants : 1. Entre mai 2010 et juin 2011, ont volontairement, de quelque manière, éludé ou tenté d’éluder le paiement d’un impôt au montant de 1 080 930 $ établi en vertu de la Loi de l’impôt sur le revenu, L.R.C. (1985) ch. 1 (5 e supplément), en réclamant de fausses pertes d’entreprise et de fausses pertes en capital net dans des déclarations T1 faires en vertu de la Loi de l’impôt sur le revenu d’une somme de 17 353 379$ commettant ainsi l’acte criminel prévu à l’article 239(1)
d) et 239(2) de la Loi de l’impôt sur le revenu. 2. Entre 2010 et juin 2011, ont, par supercherie, mensonge ou autre moyen dolosif, frustré le gouvernement canadien d’une somme d’argent d’une valeur dépassant cinq mille dollars, commettant ainsi l’acte criminel prévu à l’ article 380(1)
a) du Code criminel . [ 3 ] Le procès est fixé pour une durée de 5 semaines à compter du 24 février 2020. [ 4 ] Le 1 er octobre 2019, l’honorable Lyne Décarie, j.c.s., accueille une requête en rejet
sommaire de la demande intitulée Notice of Application for Petition for a Writ of Habeas Corpus (Praetor and Replevin) Seeking Relief Pursuant to UNDRIP. Les appelants se pourvoient et font valoir les moyens suivants :
1. The Crown must be ordered to Consult as a procedural first step, per the SCC in Tsilqot’in v BC 2014 SCC 44 at [78]. 2. the right to Treaty of the Apellants was addressed by the SCC in Daniels v Canada , where Parliament was found to have failed to legislate regarding those Appellants. 3. The SCC held in Daniels at [54] that Land Claims are to be argued by the representative of the Chief’s choice. 4. The Appellants’s Nation joined the US Articles of Confederation in 1777, per
Article XI, which Nation is never Sovereign, per
Article II. 5. The Queen of England has mandated the Prime Minister to negociate Treaty with the Appellants’ Nation. 6. Indigenous Laws are equal to British Common Law, per the SCC in Delgamuukw v BC. 7. The United Nations Declaration of the Rights of Indigenous People (UNDRIP) dictates teh Appellants are emtitled to self-governance, including their own Laws. 8. The Land Claim in Trespass asserts the Laval Superior Court is on Un-ceded Land, as also asserted in the Newmarket, Kingston and Cornwali Superior Courts in sister appeals. 9.
The Proclamation of 1982 was expressly made conditional on S.59, the language clause with Quebec, which condition has not yet been satisfied. 10. The Superior Court failed to enforce The Two Row Wampum Treaty. There is no other Treaty that transferred the Land of the Clan Mother to Ottawa. Ottawa, The Superior Court, and the ONCA are on Un-Ceded Land, which triggers The Royal Proclamation of 1763 (enshrined in S. 250f the Charter). 11. “CANADA” was cited to be only a Corporation by the SCC in Mercer y AG in 1881. 12.
Then, Queen Victoria un-enabied the BNA Act via The Statutoiy Revision Act of 1893, thereby rendering the BNA Act VOID. 13. According to The Library and Archives of Canada, it’s Libraries are ail on Un-ceded Land, which un-ceded status was confirmed in Ottawa on January 7, 2019. Un-ceded Land falis under S. 25 of the alleged Constitution Act, which expressly states that the Chief can Order trespassers off, of ail land that is ‘Unceded,” which the Chief has done. 14.
S. 35, by reference to “other right&’ outside The Royal Proclamation of 1763, and the Charter 0f the CANADA Corporation, must be enforced, so as to not diminish those rights. So ancientAllodial ownership of the land ofthe Metis is preserved. 15. The validity of the Canada Act is called into question, inter alia, by the fact Quebec neyer proclaimed the Act, nor has S. 59 (Language) been resolved, and The Royal Proclamation of 1763 cited in S. 25 has not been recognized by BC.
A Royal Proclamation from a foreign legislature is not a valid Constitution on Turtle Island for those who swear allegiance to the Kinakwii Constitution. 16. Such other grounds as counsel may advise and this Honourable Court permit [ 5 ] À la face même de ces moyens, l’appel me semble satisfaire au critère de l’ article 685 (1) C.cr . et je suis donc d’avis de déférer la requête à une formation de la Cour. POUR CES MOTIFS, LA SOUSSIGNÉE : [ 6 ] DÉFÈRE la requête à la Cour; [ 7 ] FIXE l’audition de la requête au 20 janvier 2020, à 9h30, en salle Pierre-Basile-Mignault; [ 8 ] ORDONNE à la
partie intimée de déposer trois (3) copies supplémentaires de sa requête, en prenant soin d’y joindre copie de tous les documents nécessaires à son étude. ME JULIE DEVROEDE Greffière-adjointe
