LA COUR La demande en autorisation d’appel est rejetée. The following is the judgment delivered by THE COURT [ 1 ] Alan Robert Weldon appeals his conviction on a charge of having violated s. 151 of the Criminal Code .
His grounds of appeal raise questions of fact and mixed law and fact for which, pursuant to s. 675(1)( a )(ii), leave to appeal is required. Simply put, Mr. Weldon is asking the Court of Appeal to take a different view of the evidence than did the trial judge. However, that is not our role. As the Supreme Court has repeatedly stated, findings of fact and credibility must be shown deference. Only when such findings are the result of a palpable and overriding error is a court of appeal justified to intervene. Mr. Weldon has not identified any such error.
Furthermore, none is apparent upon our review of the record. [ 2 ] For these reasons, Mr. Weldon’s application for leave to appeal is dismissed. ____________________________________ J.C.
