Article 38 de la Loi sur la protection de la jeunesse et ordonnance de mesures intérimaires ______________________________________________________________________ [ 1 ] Le tribunal confirme et motive, par le présent jugement, la décision rendue séance tenante lors de l'audience du 4 mai 2011, conformément aux exigences de l’article 90 de la
Loi sur la protection de la jeunesse . [ 2 ] Comme le permet Kellogg’s Company of Canada c. P.G. du Québec , [1978] C.A. 258 , 259-260, le tribunal s’est réservé le droit, au moment de rendre sa décision, d’en modifier, amplifier et remanier les motifs.
La soussignée les a remaniés pour en améliorer la présentation et la compréhension. [ 3 ] Le tribunal doit déterminer si la sécurité et le développement de X sont compromis et le cas échéant, pour quels motifs. [ 4 ] Les parents admettent les allégations suivantes : “3.1 as relevant background information, the child’s half-siblings are known to the Director of Youth Protection as well as the Court of Quebec, Youth Division, primarily for issues surrounding their father’s involvement with the child’s mother, as there are couple conflicts, conjugal violence at the hands of the mother as well as substance abuse from the mother, as it appears more fully from the judgments filed as Exhibit D-1; 3.2 there is a serious risk that the parents do not meet the child’s basic needs, more particularly but not restrictively in that:
a) the child tested positive to marijuana at birth;
d) the mother appears to have an address in the A area, but has been staying at the [Centre A] in TOWN A for approximately the last couple of weeks; 3.3 the mother becomes verbally and physically aggressive when she is intoxicated; 3.4 police have intervened in the home during arguments between the parents; 3.7 on February 16th, 2011, immediate protective measures were invoked and the child was placed in a confidential foster home; 3.8 serious concerns exist with regards to the mother’s consumption and volatility given the child’s tender age and vulnerability;”. [ 5 ] La Directrice de la protection de la jeunesse désire mettre en place un plan suivant lequel l’enfant pourrait être confié à sa mère après que celle-ci ait terminé un programme visant à mettre fin à son problème de consommation ou pendant son séjour à Portage,
suivant le développement de la situation. Ce projet répond aux exigences de la
Loi sur la protection de la jeunesse et paraît répondre aux intérêts de l’enfant. [ 6 ] Tout repose désormais dans la détermination de la mère, sa capacité à prioriser les besoins de son enfant et son désir de modifier son mode de vie. [ 7 ] Le père a témoigné et remis une lettre au tribunal, permettant de comprendre la situation. [ 8 ] Il est donc nécessaire de prononcer une ordonnance intérimaire afin de s’assurer que les mesures sont prises par la mère et que la sécurité de l’enfant est assurée auprès d’elle. [ 9 ] Après avoir reçu les admissions, pris en considération les témoignages, les rapports produits et la position des parties, le tribunal conclut à l'existence de motifs sérieux de compromission en application de l'article 38 b) 2 o de la
Loi sur la protection de la jeunesse et estime qu'il est dans l'intérêt de l'enfant et le respect de ses droits de rendre l'ordonnance qui suit. [ 10 ] PAR CONSÉQUENT ET POUR CES MOTIFS, LE TRIBUNAL : [ 11 ] GRANTS the motion; [ 12 ] DECLARES that the security and the development of X are in danger (section 38 b) 2 o of the Youth Protection Act ); [ 13 ] SETS the continuation of the hearing on June 16, 2011 before the undersigned at 9:30 (room to be determined); [ 14 ] In the meantime : [ 15 ] ORDERS that the child be entrusted to a foster care; [ 16 ] ORDERS mother, as she had agreed, to participate in the mother-infant program at A PROGRAM; [ 17 ] ORDERS mother, as she had agreed, to refrain from consuming all mood altering substances including but not limited to cannabis and alcohol; [ 18 ] ORDERS mother not to be under the influence of any mood altering substance when in the presence of the child; [ 19 ] ORDERS mother to undergo random drug testing as often as required by the Director of Youth Protection; [ 20 ] ORDERS the parents to ensure that the child is not exposed to any type of violence, verbal or physical; [ 21 ] RECOMMENDS mother to participate in an anger management program of therapy to learn more positive coping skills; [ 22 ] ORDERS that the frequency and modality of contacts between the child and his parents be determined by the Director of Youth Protection including supervision if deemed necessary; [ 23 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to X and his family; [ 24 ] ENTRUSTS the situation of X to the Director of Youth Protection of Batshaw Youth and Family Centres, who shall then see that the measures are carried out. __________________________________ DOMINIQUE WILHELMY, J.C.Q.
