Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). ______________________________________________________________________ [ 1 ] The present judgment confirms in writing the decision rendered orally at the hearing held on August 26, 2020. [ 2 ] La Directrice de la protection de la jeunesse (la Directrice) demande au Tribunal de prolonger son ordonnance rendue le 26 juin 2019. [ 3 ] Plus spécifiquement, elle demande de confier Isabelle (16 ans) à sa famille d’accueil actuelle, sa demi-sœur, madame C et qu’un suivi social soit offert à la famille jusqu’à la majorité de cette dernière le [...] 2022. [ 4 ] L’adolescente, par la voix de son avocat, est en accord avec les mesures proposées. [ 5 ] La mère est absente lors de l’audience.
Elle n’a pas collaboré au suivi social ordonné et a été peu présente dans la vie de l’adolescente. CONTEXTE ET ANALYSE [ 6 ] X est une adolescente de 16 ans, elle est confiée avec sa fratrie à sa demi-sœur depuis le 24 septembre 2018. [ 7 ] Depuis la dernière ordonnance, la mère ne collabore pas au suivi social et est peu impliquée dans la vie de l’adolescente. [ 8 ]
Malgré plusieurs tentatives pour entrer en contact avec elle, jusqu’à tout récemment, il a été impossible de le faire. Elle refuse tout contact avec les intervenants de la Directrice. [ 9 ] La situation de la mère n’a pas changé, elle fréquente toujours des gens qui consomment. Elle-même n’a entrepris aucune
démarche en lien avec ses difficultés personnelles. Elle n’est pas présente pour sa fille. [ 10 ] Selon l’adolescente, la mère a offert la chambre des filles à des consommateurs. [ 11 ] L’adolescente se sent abandonnée par sa mère. [ 12 ] L’adolescente évolue positivement chez sa demi-sœur. Elle s’y sent bien.
Sa sœur ainée demeure toujours avec eux. [ 13 ] Elle fréquente l’école, a un emploi à temps partiel et semble avoir cessé sa consommation. [ 14 ] Madame C voit une belle amélioration et ne note aucun problème de comportement. [ 15 ] Elle accepte de s’impliquer dans la vie de l’adolescente jusqu’à la majorité de cette dernière et même au-delà. [ 16 ] Le Tribunal estime qu’il est impossible d’envisager un retour à court, voir même à moyen terme de l’adolescente auprès de sa mère. [ 17 ] La famille d'accueil représente un projet de vie stable et défini, et du point de vue du meilleur intérêt de l’adolescente, cette dernière doit y être confiée jusqu’à sa majorité. [ 18 ] Le Tribunal estime que les mesures proposées sont dans le meilleur intérêt et le respect des droits de l’adolescente.
CONSEQUENTLY, AND FOR THESE REASONS, THE COURT: [ 19 ] GRANTS the Application; [ 20 ] DECLARES that the security and development of the adolescent continue to be endangered within the meaning of the Youth Protection Act ; AND IN VIRTUE OF THE POWERS CONFERRED UPON THE COURT BY
SECTION 91 OF THE YOUTH PROTECTION ACT: [ 21 ] ENTRUSTS the adolescent to the foster home of Mrs C; [ 22 ] ORDERS that the frequency and modality of contacts between the adolescent of the mother be determined by the Director of Youth Protection; [ 23 ] ORDERS that the mother ensure that the adolescent is not exposed of any form of violence (verbal, physical or psychological); [ 24 ] ORDERS that the mother ensure that the adolescent is not exposed to any person under the influence of drug or alcohol; [ 25 ] PROHIBITS all contact between the adolescent and D; [ 26 ] STRONGLY RECOMMENDS that the mother engage in services to address her personal issues; [ 27 ] RECOMMENDS that the adolescent engage in therapeutic services and that she follows any recommendations; [ 28 ] ORDERS to the mother to collaborate with the Director of Youth Protection; [ 29 ] WITHDRAWS from the mother the attribute of parental authority regarding medical, educational, therapeutic services, extracurricular recreational activities and travel, including obtaining a passport, and GRANTS the attribute of parental authority to Mrs C; [ 30 ] ORDERS that an extract of judgment for the attribute of parental authority be sent to Mrs C. [ 31 ] AUTHORIZES the Director of Youth Protection to exchange information with treating professionals; [ 32 ] ORDERS that aid, counsel and assistance be provided to the adolescent and the family; [ 33 ] ENTRUSTS the situation of the adolescent, X, to the Director of Youth Protection of the Centre intégré universitaire de santé et services sociaux (CIUSSS) A, who shall then see that the measures are carried out; [ 34 ] ORDERS the execution of the present judgment by any peace officer if necessary; [ 35 ] THE WHOLE until adolescent’s age of majority, which is [...], 2022.
