Impleaded party ______________________________________________________________________ ORDER FOR CONFINEMENT IN AN INSTITUTION FOLLOWING PSYCHIATRIC ASSESSMENT ( Articles 26 et ss C.c.Q. et 778 et ss C.p.c.) ______________________________________________________________________ [ 1 ] GIVEN the motion for confinement in an institution following psychiatric assessment, supported by an affidavit; [ 2 ] WHEREAS the motion was served to the respondent and her examination before the Court could be harmful to her health and security; [ 3 ] WHEREAS the motion was served on the impleaded party, who came to Court but left before the hearing; [ 4 ] GIVEN the content of the psychiatric reports by Dr.
Jean-François Lacerte, dated on May 27 and 28, 2015, the psychiatric report by Dr. Serge Breton, dated on May 29, 2015, which conclude that confinement in an institution is necessary; [ 5 ] GIVEN the respondent’s refusal to be hospitalized; [ 6 ] WHEREAS the Court has serious reasons to believe that the respondent presents a danger to herself or to others due to her mental state. In fact, the evidence shows that the respondent is very disorganized and dangerous. She suffers from paranoid schizophrenia. She is severely disorganized in her conducts. She has hallucinations and lost contact with reality.
She does not feed herself. [ 7 ] GIVEN the urgency and the need to shorten the time limit for filing the motion; THEREFORE, THE COURT : [ 8 ] ALLOWS the motion; [ 9 ] SHORTENS the presentation delay of the petition considering the emergency of the situation;
[ 10 ] DECLARES that, considering her mental state, it is obviously unnecessary to require the respondent’s testimony and WAIVES her to testify; [ 11 ] ORDERS the respondent, G.
R., to submit herself immediately to confinement in an institution at the Centre intégré de santé et de services sociaux, réseau local de services de la Baie-des-Chaleurs, Maria’s Hospital, or any other hospital centre designated by the director of professional services of the Centre intégré de santé et de services sociaux, réseau local de services de la Baie-des-Chaleurs, Maria’s Hospital; [ 12 ] ORDERS that notice of this judgement be given to the person to whom the motion was served, and ALLOWS the execution ot the judgement by a peace officer, if necessary; [ 13 ] SETS the maximum duration of the confinement in an institution to 21 days or until a new clinical psychiatric examination attests that it is no longer required; [ 14 ] THE WHOLE , without costs. __________________________________ JANICK POIRIER, J.C.Q.
