Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). ______________________________________________________________________ [ 1 ] The present judgment confirms in writing the decision rendered orally at the hearing held on January 6, 2016. [ 2 ] La Directrice de la protection de la jeunesse (la Directrice) demande au Tribunal la prolongation de l’ordonnance rendue le 15 décembre 2015 par le juge Asselin. [ 3 ] Elle demande principalement que l’enfant soit maintenu auprès de sa famille d’accueil actuelle et que les contacts mère-enfant soient suspendus.
La Directrice a entrepris des démarches en vue de l’adoption de l’enfant. [ 4 ] La mère est présente lors de l’audition elle est en accord avec les mesures proposées, elle indique qu’elle est consciente que cela est dans le meilleur intérêt de son fils. CONTEXT ANALYSIS OF THE EVIDENCE AND DECISION [ 5 ] L’enfant demeure auprès de sa famille d’accueil depuis sa naissance. Il a développé un lien significatif auprès d’elle. [ 6 ] Les mères d’accueil répondent bien à tous les besoins de l’enfant et collaborent avec la Directrice. [ 7 ] Le projet d’adoption est en cours de processus.
La mère est en accord avec le projet d’adoption. [ 8 ] La mère n’a initié aucun contact depuis l’ordonnance rendue le 12 juin 2015 puisqu’ ‘elle s’est concentrée à remettre sa propre vie sur la bonne voie. Dans les faits elle n’a pas vu l’enfant depuis mai 2014.
[ 9 ] Depuis la dernière audition, la situation de la mère s’est améliorée, cette dernière a fait de grands progrès. Par ailleurs, le Tribunal constate qu’elle demeure aux prises avec ses problèmes de santé mentale et de consommation. Cette situation l’empêche de s’occuper adéquatement de son fils. La mère est consciente de ses limites et comprend que la prolongation de l’ordonnance est nécessaire pour assurer la sécurité et le développement de X.
CONSEQUENTLY, AND FOR THESE REASONS, THE COURT: [ 10 ] GRANTS the motion; [ 11 ] EXTENDS the decision rendered on June 12, 2015; [ 12 ] DECLARES that the security and development of X continue to be endangered within the meaning of the Youth Protection Act ; IN VIRTUE OF THE POWERS CONFERRED UPON THE COURT BY
SECTION 91 OF THE YOUTH PROTECTION ACT: [ 13 ] ORDERS that the child be entrusted to a foster home; [ 14 ] PROHIBITS all the contacts between the mother and the child; [ 15 ] WITHDRAWS from the mother the exercise of all attributes of parental authority and ENTRUSTS these attributes to the Director of Youth Protection; [ 16 ] ORDERS that aid, counsel and assistance continue to be provided to the child and his family; [ 17 ] THE WHOLE for a period of 6 months; [ 18 ] ENTRUSTS the situation of X to the Director of Youth Protection A, who shall then see that the measures are carried out; [ 19 ] ORDERS the execution of the present judgment by any peace officer, if necessary.
