À tous autres égards, la peine demeure inchangée. The following is the judgment delivered by THE COURT [ 1 ] Thirty-three-year-old recidivist Clarence Greer broke and entered into the residence of Jacob Wade Isaac Spencer and repeatedly assaulted Mr. Spencer. He also damaged an interior door to access a bedroom in which Mr. Spencer had sought refuge after the initial attack. Mr.
Greer was charged, tried and convicted of break, enter and assault ( s. 348(1) (
b) of the Criminal Code ), and mischief ( s. 430(4) (b)). Because he was on probation at the time he committed those offences, he was also convicted of failing to comply with a probation order (s. 733.1(1)(b)). [ 2 ] A judge of the Provincial Court sentenced Mr. Greer to imprisonment for 677 days for the break and enter offence after having given him credit of 237 days for pre-trial custody. As for the other two offences, the judge sentenced Mr. Greer to imprisonment for 30 days for the mischief offence, to be served concurrently, and for 30 days for the breach of probation, to be served consecutively.
The judge also made some ancillary orders and imposed a victim fine surcharge to be paid forthwith. Mr. Greer declined to pay the surcharge, so the judge added four days to the total period of imprisonment in lieu of the fine. [ 3 ] Mr. Greer applies for leave to appeal the sentence. He claims imprisonment for roughly 31 months is a sentence that is disproportionate to the crimes he committed and does not respect the parity principle. In our view, there is no merit to those arguments.
The sentence imposed is not unfit for what was in effect a home invasion. [ 4 ] But for a concession contained in the submission of counsel for the Attorney General, we would have dismissed the application for leave to appeal the sentence. The concession relates to the decision of the Supreme Court of Canada in R. v. Boudreault , 2018 SCC 58 , [2018] S.C.J. No. 58 (QL) , striking down the mandatory nature of victim fine surcharges. Counsel for the Attorney General submits we ought to grant Mr.
Greer leave to appeal for the sole purpose of reducing the sentence by four days to reflect the principles set out in Boudreault . We agree. [ 5 ] For these reasons, leave to appeal is granted and the appeal is allowed. The sentence imposed in the Provincial Court is varied to remove the victim fine surcharges, resulting in a 4-day reduction of the total period of imprisonment. In all other respects, the sentence remains intact.
