Article 38 de la Loi sur la protection de la jeunesse et ordonnance de mesures intérimaires ______________________________________________________________________ [ 1 ] Le tribunal confirme et motive, par le présent jugement, la décision rendue séance tenante lors de l'audience du 21 avril 2011, conformément aux exigences de l’article 90 de la
Loi sur la protection de la jeunesse . [ 2 ] Comme le permet Kellogg’s Company of Canada c. P.G. du Québec , [1978] C.A. 258 , 259-260, le tribunal s’est réservé le droit, au moment de rendre sa décision, d’en modifier, amplifier et remanier les motifs.
La soussignée les a remaniés pour en améliorer la présentation et la compréhension. [ 3 ] Le tribunal doit déterminer si la sécurité et le développement de X et Y sont compromis et le cas échéant, pour quels motifs. [ 4 ] Au moment de l'audience, les enfants ont revu leur mère avec qui les contacts avaient été rompus depuis plusieurs années. [ 5 ] Après avoir pris connaissance du dossier, il semble approprié de prononcer une ordonnance intérimaire afin de s'assurer que le père maintiendra sa sobriété et sera plus présent auprès de ses enfants. [ 6 ] Le père a agi avec transparence et reconnaît les faits suivants relatés a la procédure : “3.1 the child is in the father’s care; 3.3 the father has a chronic alcohol addiction problem; 3.4 the child is regularly exposed to the father in his state of inebriation; 3.10 the mother is not involved with the child;”. [ 7 ] Il nie avoir un problème de jeu mais la preuve prépondérante révèle le contraire. [ 8 ] Le père doit trouver une solution a son problème d'alcool et de jeu. [ 9 ] Un parent absent ne peut répondre aux besoins de base de ses enfants, ni au niveau émotionnel ni psychologique et un parent
sous l'influence de l’alcool ne le peut pas non plus. C'est ici que se situe la compromission des enfants. [ 10 ] Durant la période intérimaire, la mère réapprendra à connaître ses enfants, à agir à leur égard avec constance et le père prendra les mesures nécessaires pour demeurer sobre et présent pour ses enfants. [ 11 ] La Directrice de la protection de la jeunesse pourra ainsi s'assurer que la situation est sous contrôle. [ 12 ] Après avoir reçu les admissions, pris en considération les témoignages, les rapports produits et la position des parties, le tribunal conclut à l'existence de motifs sérieux de compromission en application des articles 38 b) 1 o iii et b) 2 o de la
Loi sur la protection de la jeunesse et estime qu'il est dans l'intérêt des enfants et le respect de leurs droits de rendre l'ordonnance qui suit. [ 13 ] PAR CONSÉQUENT ET POUR CES MOTIFS, LE TRIBUNAL : [ 14 ] GRANTS the motion; [ 15 ] DECLARES that the security and the development of X and Y are in danger (section 38 b) 1 o iii and b) 2 o of the Youth Protection Act ); [ 16 ] SETS the continuation of the hearing before the undersigned on August 1 st , 2011 in room 2.04; [ 17 ] In the meantime: [ 18 ] ENTRUSTS X and Y to Mrs.
C; [ 19 ] ORDERS that frequency and modality of contacts between the children and their parents be determined by the Director of Youth Protection; [ 20 ] TAKES JUDICIAL NOTICE that mother intends to follow the rhythm of the children and to follow their interest; [ 21 ] ORDERS father to refrain from being under the influence of alcohol in the presence of the children; [ 22 ] ORDERS father to undergo random alcohol testing; [ 23 ] ORDERS father to follow the recommendations set forth by A Pavilion; [ 24 ] ORDERS father and mother to collaborate with the Director of Youth Protection and meet with the delegate upon request; [ 25 ] AUTHORIZES the Director of Youth Protection to obtain and share information with any of the service providers working with the family; [ 26 ] ORDERS the Director of Youth Protection to make sure that the children are not deprived of their activities during summer camp; [ 27 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to the children and their family; [ 28 ] ENTRUSTS the situation of X and Y to the Director of Youth Protection of Batshaw Youth and Family Centres, who shall then see that the measures are carried out __________________________________ DOMINIQUE WILHELMY, J.C.Q.
