Article 38 de la Loi sur la protection de la jeunesse ______________________________________________________________________ [ 1 ] Par la présente, le tribunal confirme, motive et précise une décision rendue séance tenante le 11 juin 2013. [ 2 ] Le tribunal est saisi d'une requête en protection suivant l'article 38 de la
Loi sur la protection de la jeunesse par laquelle la Directrice de la protection de la jeunesse demande de déclarer compromis la sécurité et le développement de l'enfant, X . [ 3 ] La déclaration de compromission a été déposée au dossier de la Cour le 29 février 2012. Il y est dit ceci : ”3.1 the parents do not meet the child’s basic needs, more particularly but not restrictively in that:
a) the child was born at twenty-five (25) weeks;
b) the child’s weight gain is concerning as the child is not gaining sufficient weight for his age;
c) the parents have not followed through with accessing different foods banks and resources to aid them when there is insufficient food;
d) the child appears to present some developmental delays;
e) the parents fail to provide the child with appropriate stimulation and often leave the child in his high chair for prolonged periods of time;
f) despite the CLSC’s involvement with the family since January 2011, the parents do not consistently attend the medical appointments for the child and do not adequately follow through with the recommendations made by the professionals;
g) the parents fail to recognize the severity of the child’s delays and importance in making medical appointments a priority;
h) on several occasions, the home has been observed to be untidy, cluttered, with a strong odor(sic) of cigarettes;
i) the floor has been observed to have cat food and ashtrays within reach of the child; 3.2 there is a serious risk that the parents do not meet the child’s basic needs, more particularly but not restrictively in that:
a) the father has been diagnosed with bi-polar disorder and manic depression for which he currently does not take medication to address the conditions;
b) the father admits to consuming three (3) joints of marijuana on a daily basis;
c) the father expresses having attempted suicide several years ago and has not sought any counselling;
d) the mother states that she struggles with symptoms of depression and has had some suicidal ideations which have not been addressed by any professional; 3.3 the parents do not have a stable support network; 3.4 the parents minimize the child’s needs and lack the insight into the child’s development;”. [ 4 ] Aux conclusions de ladite requête, on ne demande pas à l’époque un placement de l’enfant mais plutôt qu’il soit confié à ses parents. [ 5 ] Le 10 mai 2012, devant l’honorable juge Ruth Veillet, il y a remise de l’audition en vertu de l’article 38 de la
Loi sur la protection de la jeunesse et celle-ci maintient l’enfant avec sa mère. [ 6 ] Cependant, dès le 31 mai 2012, toujours devant l’honorable juge Ruth Veillet, il y a ordonnance d’hébergement provisoire de l’enfant en famille d’accueil. [ 7 ] Le 29 juin 2012, nouvelle remise dans le dossier devant l’honorable juge Daniel Lavery.
L’enfant est toujours confié en famille d’accueil mais cette fois-ci, il est écrit que la famille d’accueil sera confidentielle. [ 8 ] Enfin, le 16 août 2012, l’enquête débute devant la soussignée . [ 9 ] La preuve révèle effectivement que cet enfant, né après seulement 25 semaines de gestation, présente des retards de développement importants et ses parents, malgré l’aide du CLSC environnant, n’arrivent pas à faire en sorte que cet enfant reprenne les retards observés. [ 10 ] La preuve révèle cependant que la mère a de belles capacités parentales. [2] Ainsi, à la pièce D-8, page 9, on lit ceci : “Ms.
A has some positive parenting behaviours, commitment and insight. She appears to be bonded with X and committed to her parenting role, however her knowledge base for caring for a child with special needs is somewhat limited. She appears to be caught in divided loyalties between Mr. B and C and her parenting role.” [ 11 ] Le problème résulte plutôt dans sa relation avec monsieur B qui tout en n’étant pas conflictuelle, demeure problématique.
D’ailleurs bien que monsieur, en apparence, semble collaborer et avec madame et avec les intervenants, dans les faits il ne manifeste pas vraiment ni un intérêt ni un désir sincère de collaborer ce qui n’est certes pas dans l’intérêt de l’enfant qui présente toujours, le 16 août 2012, des retards importants. [ 12 ] Cependant parce que la mère désire s’impliquer davantage et compte tenu de ses capacités parentales, il y a lieu de penser à une intégration de l’enfant avec elle à [l’organisme A], prête à l’accueillir. [ 13 ] L’enfant, depuis sa naissance, n’a-t-il pas toujours vécu avec sa mère jusqu’à ce qu’on les sépare le 31 mai 2012 ? [ 14 ] Après près de 3 mois, il est temps de tout faire en sorte que mère et enfant soient réunis à nouveau. [ 15 ] Dans les circonstances, c’est sans aucune hésitation que dans un premier temps, le tribunal déclare la sécurité et le développement de cet enfant compromis aux motifs suivants, à savoir sur le plan de la santé, ses parents n’assumant pas ni ne lui permettant pas de recevoir les soins que requiert sa santé physique ou mentale (article 38 b) 1 o ii de la
Loi sur la protection de la jeunesse ). [ 16 ] De plus, il y a un risque sérieux que ses parents ne répondent à ses besoins fondamentaux (article 38 b) 2 o de la même loi). [ 17 ] Quant à la mesure, comme la mère est d’accord pour intégrer [l’organisme A] avec son enfant et comme il est de l’intérêt de cet enfant qu’il soit retourné avec sa mère dans les plus brefs délais, pour le moment, le tribunal maintient l’enfant en famille d’accueil confidentielle tout en permettant une réintégration de l’enfant avec sa mère à [l’organisme A] aussitôt que faire se peut.
Plus précisément l’ordonnance se lit ainsi : “ ORDERS that the child be placed in a confidential foster home; AUTHORIZES the reintegration of the child to his mother’s care provided that she is accepted and fully integrated into the [A Organism] Program or any other program approved by the Director of Youth Protection; ORDERS the mother to abide by the rules of the organism where she will be living with the child; ORDERS both parents to actively and respectively collaborate with the Director of Youth Protection; ORDERS Mr.
B to undergo a parental capacity assessment and to undergo an anger management program; ORDERS random drug testing for both parents; ORDERS parents to ensure that the child is not exposed to cigarette smoke or drugs during their visits; ORDERS that frequency and modalities of contact between the parents and X be determined by Director of Youth Protection including
supervision as deemed necessary; RECOMMENDS that X undergo a full developmental assessment; RECOMMENDS that parents attend all medical and developmental appointments for X; RECOMMENDS both parents to involve themselves in a parenting program; ORDERS that aid, counsel and assistance be provided to X and his family; POSTPONES the hearing on November 13, 2012, at 9:30 AM, room 2.04 for ½ day.” [ 18 ] Le dossier par la suite a été remis à quelques reprises pour différentes raisons dont principalement le fait que la mère n’a été intégrée à [l’organisme A] que le [...] 2012. [ 19 ] De son côté, le père, le 24 septembre 2012, accepte de s’engager à 15 sessions d’un programme pour régler son problème d’agressivité (anger management program).
Il accepte aussi de se soumettre à une évaluation de ses capacités parentales. [ 20 ] Entre temps, nous apprendrons que monsieur et madame se sont mariés à l’été 2012, que madame, toujours à l’été 2012, est devenue enceinte d’un enfant qui naîtra en […] 2013. [ 21 ] Le 19 février 2013, le dossier est encore reporté parce qu’à cause de tous ces éléments nouveaux, la Directrice de la protection de la jeunesse n’est pas en mesure de formuler des recommandations définitives.
Bien qu’intégrée en octobre 2012 à [organisme A], ayant dû subir une intervention chirurgicale, la mère a quitté [organisme A] pour n’y revenir que le 6 février 2013. Quant à l’enfant, il est toujours placé en famille d’accueil confidentielle. [3] [ 22 ] La décision inscrite au procès-verbal du 19 février 2013 résume bien la situation du jeune garçon.
Nous la reproduisons : “ Considering that since the first hearing on August 16 th 2012, the mother was accepted at [Organism A] on October 9 th 2012; Considering that the integration was interrupted because the mother had to undergo an operation in October 2012; Considering that the mother just reintegrated [Organism A] more than a week ago on the 6 th of February 2013; Considering that the child will reintegrate [Organism A] slowly during weekdays and will stay in the foster family during the weekends; Considering that the mother will give birth around the 22 nd of April 2013; Considering that the father completed successfully the anger management evaluation; Considering that the father must undergo a parental capacity assessment; THE COURT RENDERS THE FOLLOWING INTERIM MEASURES : ORDERS that X continue to be entrusted to a confidential foster home; AUTHORIZES the integration of the child to the mother’s care on the condition that she herself is fully integrated to [Organism A] or another program authorized by the Director of Youth Protection; ORDERS that the frequency and modality of contacts between the child and the parents be determined by the Director of Youth Protection, including supervision if deemed necessary; ORDERS the mother to abide by the rules of [Organism A] or any other residential program; ORDERS the father to undergo a Parental Capacity Assessment and following this evaluation if the situation allows RECOMMENDS STRONGLY that the child visits his father at his residence; ORDERS the father to collaborate with the interventions of the [Organism A] staff; ORDERS that both parents submit to random drug testing at the request of the Director of Youth Protection; ORDERS that both parents ensure that the child is not exposed to cigarette smoke or drugs during all contacts and visits; RECOMMENDS that the parents attend all medical and developmental appointments for the child; RECOMMENDS that the Director of Youth Protection make all necessary efforts so that the father can keep his apartment; ORDERS that aid, counsel and assistance be provided to the child and the family; SETS the continuation of the hearing on June, 11 th 2013 at 2:00 pm for half (1/2) a day in a room to be determined; WITHOUT further notice.” [ 23 ] Toutes les parties reviennent devant la Cour ce jour.
Le tribunal prend connaissance de l’évaluation des capacités parentales de monsieur effectuée par Docteur Catherine Cloutier le 28 mars 2013 (pièce D-18) de même que des documents suivants :
▪ D-19 “Progress Report”, prepared by [social worker 3], dated March 21, 2013 (filed under
Article 294.1 C.p.c.); ▪ D-20 Addendum to “Progress Report”, prepared by [social worker 3], dated June 5, 2013 (files under
Article 294.1 C.p.c.); ▪ D-21 Addendum #4, prepared by [social worker 2], dated June 4, 2013; ▪ D-22 Letter from D, dated March 1, 2013. [ 24 ] La preuve révèle que l’enfant X qui maintenant vit avec sa mère à [organisme A] y évolue bien. [ 25 ] Ainsi à la page 2 du rapport D-19, on lit ceci : “ Child’s Development: X has been diagnosed as having developmental delays. This being said, X is doing well in the [organism A] infant stimulation program, as well as doing daily activities.
His gross motor skills are improving – X is walking more steadily and he has started to climb steps under the watchful eye of his mother. His fine motor skills are getting stronger – X is becoming more skilled at self-feeding. His language skills are improving favourably. He speaks more clearly everyday and it seems he understands more words daily and many times he will answer his mom or others when he is asked a question. X is becoming more skilled and curious. He has started to name objects illustrated in picture books.
Relationship wise – X smiles and appears to recognize him(sic) mom when she talks to him or when she enters a room. As well, X has adjusted to transitioning from a baby crib to a toddler bed.” [ 26 ] Quant à la mère, la description de sa situation est, on ne peut plus, positive. Ainsi toujours en page 2 du rapport D-19 : “ Mother’s Situation: Ms. A has positive interactions with staff and residents, and seems to be well received by the other mothers in the residential program. Her positive attitude contributes to the group living dynamics. Ms. A is an active participant in scheduled programming. Ms.
A is willing to share suggestions with staff regarding things on which she is working with X at the A Rehabilitation Centre. She takes great initiatives to practice these behaviours as exampled by how she is letting X walk up the steps, teaching him to self-feed, and how she is working on language development. Ms. A displayed a positive bond with her son X. X also demonstrated a healthy attachment to his mother. This being said, at times Ms.
A appeared over protective of letting X leave her side.” [ 27 ] Quant au père, tel que nous l’avions souligné au tout début de l’audition du 16 août 2012, monsieur semble bien collaborer en apparence mais en réalité c’est une toute autre chose. [ 28 ] Effectivement, il a assisté à 15 sessions pour régler son problème d’agressivité.
Son témoignage à la Cour, son attitude, ses remarques amènent le tribunal à constater que monsieur bénéficierait encore grandement d’autres sessions pour améliorer son problème d’agressivité. [ 29 ] Monsieur s’est soumis à une évaluation de ses capacités parentales tel que dit plus haut, mais les conclusions de l’évaluateur sont pour le moins, mitigées. [ 30 ] Quant aux contacts qu’il a avec son fils X de même qu’avec le bébé, ils sont plus ou moins heureux, plus au moins assidus.
Il nous dira en Cour : « I want to get my family back together » mais en réalité il apparaît clair qu’il ne pose pas les gestes qu’il devrait faire pour faire en sorte que la famille soit réunie à nouveau. [ 31 ] Tel que demandé par Docteur Cloutier, il consent cependant à se soumettre à une évaluation psychiatrique et à une évaluation pour contrecarrer son problème de drogue. [ 32 ] Est-il vraiment sincère ?
Nous le verrons. [ 33 ] De son côté, nous le répétons, la mère et les deux jeunes enfants évoluent bien mais il y a lieu, compte tenu de la lourdeur de la tâche pour madame, et compte tenu du fait que monsieur n’évolue pas actuellement dans le même sens que madame, d’ordonner ce qui est recommandé à la page 6 du rapport D-21. [ 34 ] PAR CONSÉQUENT ET POUR CES MOTIFS, LE TRIBUNAL REND LA MESURE DÉFINITIVE SUIVANTE : [ 35 ] ORDERS that the child be entrusted to mother conditional on her residing at [Organism A] or another program authorized by the Director of Youth Protection; [ 36 ] ORDERS that the frequency and modality of contacts between the child and his father be determined by the Director of Youth Protection including supervision and TAKES NOTICE that these contacts are actually twice a month for at least 2 hours; [ 37 ] RECOMMENDS that those contacts be increased; [ 38 ] ORDERS father, as he had agreed, to undergo a psychiatric evaluation and RECOMMENDS father to go through with the recommendations that could be made by the psychiatrist (medication); [ 39 ] ORDERS father, as he had agreed, to go to Foster Pavilion to have an assessment concerning his substance abuse problem (July 11, 2013);
[ 40 ] TAKES NOTICE that father will go through his mental health issues the [Center A]; [ 41 ] RECOMMENDS father to involve himself in an another Anger Management Program; [ 42 ] ORDERS both parents to ensure that the child is not exposed to cigarette smoke or drugs during all contacts visits; [ 43 ] ORDERS both parents to ensure that the child is not exposed to any verbal or physical violence; [ 44 ] AUTHORIZES the Director of Youth Protection to obtain and share information with all service providers working with the family; [ 45 ] ORDERS that aid, counsel and assistance be provided to the child and his family for a period one (1) year; [ 46 ] RECOMMENDS that at the next meeting of father with social services that Mrs. [social worker 4] attends in order act as sort of mediator between father and DYP; [ 47 ] ENTRUSTS the situation of X to the Director of Youth Protection of C Youth and Family Centres, who shall then see that the measures are carried out.
