Entreprise de Location S. & H. lté

e) and 500-32-149876-155 (3128172 Canada Inc. v. Exact Automobile and 9172-9368 Québec Inc.).

The same evidence was adduced in all 3 cases. [ 2 ] Plaintiff had the burden of proof (arts. 2803 and 2804 of the Civil Code of Quebec ). [ 3 ] WHEREAS , according to the preponderance of evidence (exhibits P-1 to P-15 and D-1 to D-5, as well as the testimony of Howard Ostroff, Melissa Samatas, Terry Murphy, Alexander Lekas, Anthony Fernandez, Gerry Bohbot and Sandra Tatarsky), no contract intervened plaintiff and Exact Automobile Inc., Entreprise de Location S. & H. ltée and Samatas Enterprises Ltd, nor between plaintiff and Anthony Fernandez. [ 4 ] As regards to defendant 9172-9368 Québec Inc., it appears from the preponderance of evidence, that plaintiff issued erroneous and/or false invoices.

The claim is therefore without merit. WHEREFORE THE COURT HEREBY: DISMISSES plaintiff's claim, with legal costs in the amount of $240.00 in favor of 9172-9368 Canada Inc. and $300.00 jointly in favor of Exact Automobile Inc., Entreprise de Location S. & H. ltée and Samatas Enterprises Ltd.
