Article 38 de la Loi sur la protection de la jeunesse et ordonnance de mesures intérimaires ______________________________________________________________________ [ 1 ] Le tribunal confirme et motive, par le présent jugement, la décision rendue séance tenante lors de l'audience du 11 février 2011, conformément aux exigences de l’article 90 de la
Loi sur la protection de la jeunesse . [ 2 ] Comme le permet Kellogg’s Company of Canada c. P.G. du Québec , [1978] C.A. 258 , 259-260, le tribunal s’est réservé le droit, au moment de rendre sa décision, d’en modifier, amplifier et remanier les motifs. La soussignée les a remaniés pour en améliorer la présentation et la compréhension. [ 3 ] Le tribunal doit déterminer si la sécurité et le développement de X sont compromis et le cas échéant, pour quels motifs. [ 4 ] La Directrice de la protection de la jeunesse soutient que la sécurité et le développement de l’enfant sont compromis en application des articles 38 b) 2 o , b) 1 o iii et 38.1 de la
Loi sur la protection de la jeunesse soit en raison du risque sérieux que les parents ne répondent pas aux besoins fondamentaux de cette enfant, du fait que les parents ne répondent pas aux besoins fondamentaux de cette enfant sur le plan éducatif et compte tenu des nombreuses absences scolaires de X. [ 5 ] La mère admet les allégations suivantes : “3.5 the parents do not meet the child’s basis needs in failing to take the necessary steps to provide the child with schooling, more particularly, but not restrictively in that:
a) the child missed approximately 19 days of school since the beginning of the school year;
b) the mother claims that the child missed school for medical reasons, but has never provided any medical note to support her statements;
c) there is a history of the child missing numerous days in school; 3.6 there is a serious risk that the mother does not meet the child’s basic needs, more particularly but not restrictively in that:
b) the mother denies having any alcohol consumption issues; 3.7 the mother refuses to collaborate with the youth protection worker, more particularly, but not restrictively in that:
a) the mother refuses to allow the youth protection worker in her home;
b) the mother refuses to provide the youth protection worker with any information on the child’s health, despite stating that she is very ill;”. [ 6 ] Après avoir reçu les admissions, pris en considération les témoignages, les rapports produits et la position des parties, le tribunal conclut à l'existence de motifs sérieux de compromission en application des articles 38 b) 1 o iii et 38.1 de la
Loi sur la protection de la jeunesse . Quant au motif mentionné à l’article 38 b) 2 o de la
Loi sur la protection de la jeunesse , le tribunal réserve sa décision sur cette question jusqu’à la poursuite de l’enquête. Le tribunal estime en outre qu'il est dans l'intérêt de l'enfant et le respect de ses droits de rendre l'ordonnance qui suit. [ 7 ] PAR CONSÉQUENT ET POUR CES MOTIFS, LE TRIBUNAL : [ 8 ] DÉCLARE compromis la sécurité et le développement de X (articles 38.1 et 38 b) 1 o iii de la
Loi sur la protection de la jeunesse ) ; [ 9 ] RÉSERVE sa décision sur le motif de compromission relié à l’application de l’article 38 b) 2 o de la
Loi sur la protection de la jeunesse ; [ 10 ] FIXE la continuation de l’enquête au 15 avril 2011 devant la soussignée en salle 2.04 pour une durée de deux (2) heures ; [ 11 ] Dans l’intervalle : [ 12 ] ENTRUSTS the child to her mother’s care, Mrs.
A; [ 13 ] ORDERS the Director of Youth Protection to submit the child to a full medical evaluation; [ 14 ] ORDERS the Director of Youth Protection to contact Doctor C [ 15 ] AUTHORIZES the Director of Youth Protection to have access to the file of the child at Hospital A; [ 16 ] ORDERS that the child receive all medication, examination or services that she may need; [ 17 ] AUTHORIZES the Director of Youth Protection to have access to X’s school; [ 18 ] ORDERS the Director of Youth Protection to make contact with the new school to verify her attendance; [ 19 ] ORDERS that X attends school with fail unless excused by a medical note; [ 20 ] ORDERS mother to undergo random alcohol testing; [ 21 ] ORDERS the Director of Youth Protection to make unannounced visits at mother’s home; [ 22 ] ORDERS mother to open the door to the Director of Youth Protection; [ 23 ] ORDERS mother and the child to collaborate with the Director of Youth Protection; [ 24 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to X and her family; [ 25 ] ENTRUSTS the situation of X to the Director of Youth Protection A, who shall then see that the measures are carried out. __________________________________ DOMINIQUE WILHELMY, J.C.Q.
