CIUSSS DU CENTRE-SUD-DE-L’ÎLE-DE-MONTRÉAL and SONIA BÉLANGER and BRUCE TRATT Defendants ______________________________________________________________________ JUDGMENT ______________________________________________________________________ [ 1 ] This proceeding was consolidated and tried at the same time as the proceedings in cases n° 500-32-153346-160 [1] and n° 500-32- 153373-164, [2] and determined on the same evidence. [ 2 ] Plaintiff’s allegations read as follows: “Dating back to March 1 2015.
You didn’t respect our privacy, negligent in their duty, incompetent, a breach of trust, abuce of power, abuce of their office, Malicious Intent and Harassment.” (sic) (application filed on March 1, 2018) [ 3 ] Plaintiff’s recourse must be denied for several reasons. [ 4 ] Plaintiff had the burden of proof (arts. 2803 and 2804 of the Civil Code of Québec ). [ 5 ] The Court heard many witnesses: Sylvain St-Pierre; Geneviève Boyer; Stéphanie Desmarais; Maria Arteaga; Diane Brennan; Elaine Crombie; Merveille Kaseka; Annie Marleau; Marie-Hélène Leduc; Nancy Latraverse; as well as plaintiff and defendants Sonia Bélanger ( declaration pour valoir témoignage ) and Bruce Tratt. [ 6 ] By and large, the testimony of all of the witnesses and defendants herein, clearly demonstrates that defendants carried out all of their duties responsibly and professionally, with care and diligence, and in the best interest of J.
L. and L. L. [ 7 ] Furthermore, plaintiff was unable to prove that defendants committed a single fault against him, personally. [ 8 ] At trial, plaintiff admitted that he was suing Tratt and Bélanger “for the work they did”.
[ 9 ] There is therefore no lien de droit between plaintiff and Tratt or Bélanger, who were acting on behalf of the CIUSSS, and not in a personal capacity. [ 10 ] Moreover, defendant Bélanger never met plaintiff, as stated below: « DÉCLARATION POUR VALOIR TÉMOIGNAGE (art. 555 C.p.c.) Je, soussignée, Sonia Bélanger, Présidente-Directrice générale du Centre intégré universitaire de santé et de services sociaux du Centre- Sud-de-l'île-de-Montréal (« CCSMTL »), ayant mon domicile professionnel au 1560, rue Sherbrooke Est, Montréal (Québec) H2L 4M1, déclare ce qui suit : […] 3. Je conteste la demande qui m’est adressée personnellement pour les motifs suivants:
a) Le demandeur poursuit le CSSS-Sud-Ouest-Verdun, M. Tratt et moi- même, à
titre personnel;
b) Je suis la présidente-directrice générale du Centre intégré universitaire de santé et de services sociaux du Centre-Sud-de-l’île-de- Montréal lequel est issu de la fusion en 2015 de diverses installations, dont notamment le défendeur CSSS-Sud-Ouest-Verdun, (ci-après « CCSMTL »);
c) La mise en demeure transmise par le demandeur m'est adressée à
titre de Directrice du CCSMTL et non à
titre personnel;
d) Les faits reprochés à la demande le sont au CCSMTL et non à moi personnellement;
e) Je n’ai à aucun moment rencontré le demandeur et je n'ai jamais agi à
titre personnel dans quelconque situation impliquant le demandeur; » (deponent’s statement, dated October 4, 2018) [ 11 ] Additionally, defendant Tratt had no dealings whatsoever with plaintiff, from March 26, 2013, onwards. [ 12 ] Plaintiff’s allegation that the facts date back to March 1, 2015, is therefore untrue, and the action against Tratt is prescribed (art. 2925 C.C.Q .). [ 13 ] Finally, many if not all of the above-mentioned witnesses also testified before the Human Rights Tribunal, in a separate matter involving Rankin and L. L.
The Tribunal found against plaintiff and concluded, inter alia , as follows: « [1] La Commission des droits de la personne et des droits de la jeunesse (la Commission) allègue à l’encontre du défendeur, K. R., qu’au cours des années 2012 et 2013 il a porté atteinte de manière illicite et intentionnelle au droit de L. L. (Mme L.) et de son mari feu J. D. d’être protégés contre l’exploitation des personnes âgées, en profitant de leur vulnérabilité à son bénéfice personnel, ce, en contravention de l’
article 48 de la Charte des droits et libertés de la personne (la Charte ). […] [224] Étant donné ce qui précède, le Tribunal conclut que M. R. a exploité J. D. et L. L. […] [234] Le Tribunal conclut donc qu’en agissant comme il l’a fait, M. R. a porté atteinte à la dignité de M. et Mme L. en contravention des articles 4 et 10 de la Charte . » [3] [ 14 ] Under the circumstances, the Court deems plaintiff’s testimony to be highly compromised and unreliable. [ 15 ] WHEREAS plaintiff did not fulfill his burden of proof; WHEREFORE THE COURT HEREBY: DISMISSES plaintiff’s claim, the whole with legal costs. _______________________________ ELIANA MARENGO, J.C.Q.
