Counsel at hearing: For the appellant: Monica McQueen and Christian Girouard-Leclerc For the respondent: Nathan Gorham Avocats à l'audience : Pour l’appelante : Monica McQueen et Christian Girouard-Leclerc Pour l’intimé : Nathan Gorham THE COURT The appeal is dismissed. LA COUR Rejette l’appel. The following is the judgment delivered by THE COURT [ 1 ] Following his conviction for certain drug-related offences, Luc LeBlanc was sentenced to imprisonment for a term of 19.5 months (six years less credit for time served on remand). Mr.
LeBlanc appealed his conviction on numerous grounds while the Crown appealed the sentence, arguing it should have been calculated based on a period of incarceration of nine years. [ 2 ] In its judgment rendered today regarding the conviction appeal (file 55-16-CA), the Court allows the appeal, sets aside the convictions and orders a new trial. [ 3 ] It follows that the sentence appeal has become moot, and, for that reason, it is dismissed.
