In the case of : X ([…] 1997) JUDGMENT ON A MOTION FOR REVISION (Sec. 95(1) Youth Protection Act) [ 1 ] The Director of Youth Protection seeks the revision of an order made on June 7, 2011, maintaining the child with her parents. [ 2 ] In a draft agreement signed by the parties and their attorneys the following facts are acknowledged : 2.1.

The youth displays behavior problems; 2.2. The youth often disregard the authority; 2.3. Since the beginning of the school year, the youth has been attending school on a irregular basis; 2.4. When she is attending school, the youth is often sleeping on her desk or not collaborating in class; 2.5. The youth displays aggressive behavior towards other children; 2.6. The youth displays violent outburst when she does not get her way; 2.7. The youth sometimes leaves the house during the night without permission; 2.8.

The parents are unable to provide a structured environment required by the youth; [ 3 ] The parties also agreed on the measures that will be ordered in order to put an end to the situation of danger for the youth's security and development. [ 4 ] FOR THESE REASONS THE COURT : [ 5 ] GRANTS the motion for revision; [ 6 ] ORDERS that the child be entrusted to a rehabilitation center chosen by the institution operating a child and youth protection center for a period of four months with a progressive reinsertion when the situation permits it; [ 7 ] ORDERS that the child attend school every day and participate in her classes;

[ 8 ] ORDERS that a person working for an institution provide aid, counseling and assistance to the child and child's family; [ 9 ] ORDERS that the measures ordered on June 7 th be maintained after the child's time in the rehabilitation center; [ 10 ] ENTRUTS the youth's situation to the Director of Youth Protection for the enforcement of this order; PC/nc PAUL CHEVALIER, J.C.Q.
