Article 95 de la Loi sur la protection de la jeunesse ______________________________________________________________________ [ 1 ] Le tribunal confirme et motive, par le présent jugement, la décision rendue séance tenante lors de l'audience du 13 mai 2013, conformément aux exigences de l’article 90 de la
Loi sur la protection de la jeunesse . [ 2 ] Comme le permet Kellogg’s Company of Canada c. P.G. du Québec , [1978] C.A. 258 , 259-260, le tribunal s’est réservé le droit, au moment de rendre sa décision, d’en modifier, amplifier et remanier les motifs. La soussignée les a remaniés pour en améliorer la présentation et la compréhension. [ 3 ] Le tribunal doit déterminer s’il est dans l'intérêt des enfants de prolonger la décision rendue le 16 octobre 2012. [ 4 ] À cette date, le tribunal confie X et Z en centre de réadaptation alors que Y et A sont confiées à leur mère.
Le tribunal impose en outre des mesures ayant pour but de mettre fin à la situation de compromission. [ 5 ] La situation s’est réellement améliorée depuis 2011 puisque la mère a fait tous les changements nécessaires dans son style de vie et dans sa perception de la situation et ce, dans l’intérêt des enfants. [ 6 ] Elle a démontré à la Directrice de la protection de la jeunesse et au tribunal qu’elle est capable de prendre charge de ses filles de façon adéquate.
Sa collaboration avec la Directrice de la protection de la jeunesse et l’éducatrice de milieu a fait en sorte qu’aujourd’hui la Directrice de la protection de la jeunesse demande au tribunal de confier Z à sa mère. [ 7 ] Quant à X, la Directrice de la protection de la jeunesse suggère qu’il demeure en centre de réadaptation pour une certaine période. [ 8 ] Le jeune homme lui-même accepte de demeurer en centre de réadaptation jusqu’au 31 décembre prochain et désire être réintégré auprès de sa mère par la suite. [ 9 ] Le tribunal tient à souligner que la mère peut être fière d’elle-même en ce qui a trait aux changements qu’elle a apporté à son mode de vie.
[ 10 ] Après avoir reçu les admissions, pris en considération la position des parties et la preuve testimoniale et documentaire, le tribunal estime que les faits prouvés et admis permettent la prolongation de l’ordonnance rendue le 16 octobre 2012 et qu'il est dans l'intérêt des enfants et le respect de leurs droits de rendre l'ordonnance qui suit. [ 11 ] PAR CONSÉQUENT ET POUR CES MOTIFS, LE TRIBUNAL : [ 12 ] GRANTS the motion; [ 13 ] DECLARES that the security and the development of X and Y and Z and A are still in danger; [ 14 ] EXTENDS the orders rendered on October 16, 2012; [ 15 ] In the case of Z : [ 16 ] ENTRUSTS Z to his mother’s care, Mrs.
B; [ 17 ] ORDERS that the frequency and modality of contacts between Z and Mr. C be determined by the Director of Youth Protection, including supervision as long as deemed necessary; [ 18 ] RECOMMENDS Mr. C to continue to seek services and engage in treatment regarding his substance abuse and conjugal violence and report to the Director of Youth Protection with respect to his progress; [ 19 ] RECOMMENDS Mr.
C to submit to random drug and alcohol testing; [ 20 ] ORDERS mother to collaborate with the Director of Youth Protection and with the educator from A Program; [ 21 ] ORDERS Z to continue to behave; [ 22 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to Z and his family; [ 23 ] THE WHOLE for a period of one (1) year; [ 24 ] In the cases of Y and A : [ 25 ] ORDERS that Y and A remain entrusted to their mother’s care, Mrs.
B; [ 26 ] ORDERS that frequency and modality of contacts between Y and her father be determined by the Director of Youth Protection, including supervision as long as deemed necessary; [ 27 ] ORDERS that frequency and modality of contacts between A and Mr. C be determined by the Director of Youth Protection, including supervision as long as deemed necessary; [ 28 ] ORDERS the Director of Youth Protection to make sure that the art therapy can resume in September 2013; [ 29 ] RECOMMENDS Mr.
C to continue to seek services and engage in treatment regarding his substance abuse and conjugal violence and report to the Director of Youth Protection with respect to his progress; [ 30 ] RECOMMENDS Mr.
C to submit to random drug and alcohol testing; [ 31 ] ORDERS mother to collaborate with the Director of Youth Protection and with the educator from A Program; [ 32 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to Y, A and their family; [ 33 ] THE WHOLE for a period of one (1) year; [ 34 ] In the case of X: [ 35 ] ORDERS that X remains in a rehabilitation centre until December 31, 2013 with reintegration to his mother’s care when mother and the adolescent agree to do so and if the Director of Youth Protection considers that it is appropriate; [ 36 ] ORDERS that frequency and modality of contacts between X and his father be determined by the Director of Youth Protection including supervision if deemed necessary and as long as necessary; [ 37 ] TAKES JUDICIAL NOTICE of the fact that X and his father have phone contacts sometimes; [ 38 ] ORDERS father to continue to seek services and engage in treatment regarding his substance abuse and conjugal violence and report to the Director of Youth Protection with respect to his progress; [ 39 ] RECOMMENDS father to submit to drug and alcohol testing; [ 40 ] ORDERS the Director of Youth Protection to make sure that X receives psychological services within the next thirty (30) days; [ 41 ] ORDERS mother to collaborate with the Director of Youth Protection and with the educator from A Program; [ 42 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to X and his family;
[ 43 ] THE WHOLE for a period of one (1) year; [ 44 ] ENTRUSTS the situation of X and Y, Z and A to the Director of Youth Protection A, who shall then see that the measures are carried out; [ 45 ] ORDERS the execution of the present decision by any peace officer. __________________________________ DOMINIQUE WILHELMY, J.C.Q.
