Mihary Andrianaivo Clerk BY THE JUDGE JUDGMENT [ 1 ] Appellants present a motion pertaining to the filing of their factum on appeal: a motion to extend the delays to file their factum until September 16, 2016. [ 2 ] This is a second motion to extend.
On August 3, 2016, my colleague justice Kasirer granted a first motion to extend to August 23, 2016 ( 2016 QCCA 1258 ). [ 3 ] Respondents do not contest the request to extend again the time limit to file the factum, but they make representations
concerning the length of the additional delay and the documents. [ 4 ] In light of the reasons alleged in appellants’ second motion to extend supported by the affidavit of counsel, I am of the view the time limit may be extended pursuant to
section 71(
e) of the Rules of the Court of Appeal of Quebec in Criminal Matters until 4:30 p.m. on September 9, 2016. FOR THE FOREGOING REASONS, THE UNDERSIGNED: [ 5 ] GRANTS the second motion to extend the time limit to file appellants’ factum until September 9, 2016 at 4:30 p.m. Without legal costs.
