Introduction [ 1 ] The Crown appealed an order made under s. 490.012 of the Criminal Code wherein the trial judge ordered the respondent comply with the registration requirements of the Sex Offender Information Registration Act , S.C. 2004, c. 10, for a period of 20 years. The appellant argued that, pursuant to s. 490.013(5) and s. 490.012(3)(
a) of the Code , the duration of the order should have been for life. At the conclusion of the hearing, we granted the appeal, ordered the decision of the trial judge on this point be set aside, and further ordered that “the respondent comply with the provisions of the Sex Offender Information Registration Act and that this order is to apply for life”. That same day, we executed an “Order to Comply With Sex Offender Information Registration Act” in Form 52. After giving our decision, we indicated brief written reasons would follow. Here are those reasons. II.
Background [ 2 ] On November 17, 2010, the respondent pled guilty to a charge of sexual assault, an indictable offence under s. 271(1)(
a) of the Code . At the sentencing hearing, the respondent’s criminal record was admitted. It reveals two prior convictions for sexual assault, both under s. 271. The Crown requested that the trial judge impose an order under s. 490.012 of the Code , and that the duration of the order be for a period of twenty years. The trial judge so ordered. Upon subsequently discovering its error, the Crown appealed. III. Law and Analysis [ 3 ] The relevant sections of the Code are as follows:

(1) L’ordonnance prend effet à la date de son prononcé. […] Durée de l’ordonnance
(5) L’ordonnance visée au paragraphe 490.012(3) s’applique à perpétuité. [ 4 ] The wording of s. 490.012(3) and s. 490.013(5) is clear and unambiguous, as is the inclusion of sexual assault (s. 271) as a designated offence under s. 490.011(1). The Crown was required to make application to the trial judge to have an order for
compliance with the provisions of the Sex Offender Information Registration Act issue, but the Crown had no basis upon which to request that the duration of the order be for 20 years. Similarly, the trial judge had no authority to order that the duration be for any term other than life. IV. Disposition [ 5 ] It is for these reasons that we granted the appeal, ordered the decision of the trial judge be set aside, and made the order that should have been made in first instance (see R. v. W.C.T. , 2006 NBCA 45 , 298 N.B.R. (2d) 76 , per Drapeau C.J.). ____________________________________ WALLACE S.
