Article 38 L.P.J. ______________________________________________________________________ MISE EN GARDE : La
Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d'identifier un enfant ou ses parents. Quiconque contrevient à cette disposition est passible d'une amende. [articles 11.2.1 et 135 L.P.J .] [ 1 ] Le présent jugement constitue la version écrite du jugement rendu séance tenante lors de l'audience tenue le 28 avril 2015. [ 2 ] Le Tribunal poursuit l'enquête commune dans la situation des enfants Y , Z et X ainsi que A et B . [ 3 ] Le 2 février 2015, le Tribunal déclarait la sécurité et le développement des enfants compromis pour les motifs allégués, et ce, en vertu des articles 38b)(1)ii) et 38b)(1)iii) de la
Loi sur la protection de la jeunesse («LPJ») . [ 4 ] À la demande de la requérante, visant à supporter le projet des parents de s'établir à Ville A [dans la province A], Le Tribunal acceptait de reporter l'enquête sur les mesures afin de permettre aux parents de concrétiser leur plan et d'assurer que la situation des enfants puisse être assumée par le Children's Aid Society A . [ 5 ] Les parents s'engageaient alors à être présents à l'audience du 28 avril 2015. [ 6 ] Les parents étaient au courant de cette date d'audition, ont même participé au choix de cette date et se sont déclarés satisfaits de procéder à cette date. [ 7 ] Le 28 avril, les parents sont absents. [ 8 ] Ils sont appelés à l'intercom, ne répondent pas et l'intervenante sociale témoigne à l'effet qu'ils ont quitté leur logement et le Québec depuis plusieurs jours. [ 9 ] La Directrice est sans nouvelle d'eux depuis. [ 10 ] Le Tribunal procède en leur absence, tenant compte des faits allégués, de la récurrence de ces faits et de la nécessité de protéger les enfants. [ 11 ] La requérante demande au Tribunal de confier les enfants à leurs parents et d'ordonner un suivi social pour une période d'une (1) année, visant à permettre aux parents d'actualiser leurs engagements afin de permettre à leurs enfants d'être scolarisés, de sortir de leur isolement et d'obtenir les soins et services de santé requis par leur état, incluant une réponse à leurs besoins médical, d'instruction et psychologique.
[ 12 ] Dans un rapport [1] déposé sous la cote D-5, l'intervenante sociale analyse ainsi la situation depuis l'ordonnance du 2 février 2015: « On February 2, 2015, Mr. D reported that he was not able to
schedule a follow-up appointment with this caseworker. On February 9, 2015, Mr. D informed this caseworker through correspondence that he and the family travelled to Pakistan on February 6, 2015. E-mail confirmation stated that the family would return to Town B on April 24, 2015. On February 26, 2015, this caseworker contacted Ms. E ([School Board A] - Homeschooling Department). She explained that she does not believe it would be a viable choice for the children to be registered for homeschooling as the parents have been unable to provide the [School Board A] with a curriculum despite instruction to do so.
On April 8, 2015, this caseworker confirmed with [Social Worker 3], intervenent de milieu en habitation pour [l’organisme A], a subsidized housing organization where the family resided, that Mr. D signed a lease termination agreement on January 16, 2015. Ms. [Social Worker 3] confirmed via e-mail that the family agreed to terminate the lease for Feburary 28, 2015, however they left the apartment on Feburary 15, 2015. There is currently no known address in Town B for the family. On April 10, 2015, Mr.
D sent a correspondence to this caseworker via e-mail stating that the family would not be returning to Town B on the expected April 24, 2015 date nor the
Article 38 hearing scheduled for April 28, 2015, due to a property distribution issue and medical follow-up for Ms. C, in Pakistan. Mr.
D explained that he will notify this caseworker of a new return date and would need a minimum of a 2 month gap after arriving in Town B to continue with the DYP process. » [ 13 ] La requérante a aussi déposé des cartes d'embarquement en lien avec les déplacements de la famille. [ 14 ] Le Tribunal conclut que les recommandations de la requérante sont dans l'intérêt de l'enfant. [ 15 ] THEREFORE, THE COURT : [ 16 ] ENTRUSTS the child X to the care of her parents; [ 17 ] ORDERS that the child X attend a recognized educational facility as of September 1 st , 2015; [ 18 ] ORDERS that the parents collaborate and meet with the worker upon request; [ 19 ] ORDERS that the parents ensure that the adolescent medical, educational and psychosocial needs are met; [ 20 ] ORDERS that the parents ensure that the adolescent attend school regularly, be prompt and ORDERS that the parents fully collaborate with the school professionals; [ 21 ] AUTHORIZES the DYP to share and obtain information with any professionals involved with the family; [ 22 ] ORDERS that the parents keep the DYP informed of their relocation plans and exact date of departure and return; [ 23 ] ORDERS that a person working for a Child and Youth Protection Centre provide aid, counsel and assistance to the child X and her family; [ 24 ] THE WHOLE until September 1 st , 2016. [ 25 ] GIVEN the evidence that notwithstanding the commitment of the parents to be present here and their plan to go live in [province A]; [ 26 ] GIVEN that the evidence reveals that the family probably left the country; [ 27 ] GIVEN that the security and development of the adolescent were declared endangered on February 2, 2015; [ 28 ] GIVEN the absence of the parents and the adolescent; [ 29 ] THE COURT: [ 30 ] ISSUES an order to all peace officers to search for and bring the adolescent before the DYP according to
