Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The director of youth protection (DYP) asks the Court to extend the application of protective measures concerning the adolescent and notably to entrust the latter to a foster family for the next year. [ 2 ] Despite the fact that she still faces challenges, the adolescent’s situation has improved since the last judgment was rendered. [ 3 ] Since December 2018, the adolescent lives with her new foster family, namely her paternal grandmother. Her behaviour has improved significantly.
She now succeeds in school. She is also part of a rugby team which requires weekly commitment. [ 4 ] However, the adolescent still struggles with anxiety, which at times is triggered by marijuana use. It sometimes leads her to adopt impulsive behaviour. [ 5 ] In April, the adolescent is brought to the hospital, following an attempted medication overdose. She was assessed and then released. [ 6 ] The adolescent participates in counselling sessions with an addiction worker.
She also meets with a worker acting as a “big sister.” Moreover, she gets support in coping skills through traditional teachings, from a home support worker in the community. The youth cooperates actively in all her follow-ups. [ 7 ] The father agrees with his daughter remaining with her grandmother. [ 8 ] The father also receives professional help. He meets with a psychiatrist. He now acknowledges that his anger management issues have impacted on his children in the past.
He cooperates with social services. [ 9 ] The mother is not actively involved in the adolescent’s life at the moment. [ 10 ] The evidence convinces the Court that the application is well founded and the recommended measures are in the adolescent’s best interest.
FOR THESE REASONS AND THOSE EXPRESSED ORALLY AT THE HEARING, THE COURT: [ 11 ] GRANTS the application for revision and extension of order; [ 12 ] DECLARES that the security and development of X are still considered to be in danger according to
section 38 of the youth protection act ; [ 13 ] REVISES AND EXTENDS the Court order rendered on July 5, 2018; [ 14 ] ENTRUSTS the adolescent to a foster family designated by the DYP until August 31, 2020; [ 15 ] RECOMMENDS that the adolescent continue to involve herself in addiction and personal follow-up; [ 16 ] ORDERS that the adolescent and her parents actively participate in the application of the measures ordered; [ 17 ] ORDERS that a person working for an establishment provide aid, counsels and assistance to the adolescent and her family until August 31, 2020; [ 18 ] ENTRUSTS the situation of the adolescent to the director of youth protection of the Centre intégré de santé et de services sociaux A for the carrying out of the judgment. __________________________________ JANICK POIRIER, J.C.Q.
