[ 1 ] Le Tribunal est saisi d'une demande en révision d'une ordonnance rendue par le soussigné le 8 septembre 2015. [ 2 ] Le Directeur recommande la poursuite du placement de Y chez sa grand-mère paternelle jusqu'à sa majorité et la réintégration progressive de X auprès de sa mère au cours des prochains mois.
La mère et la grand-mère consentent. Le père est absent. [ 3 ] Depuis la dernière année, madame A a fait d'énormes progrès. Elle est maintenant capable d'introspection et accepte ses limites. Elle voit ses enfants tous les week-ends, chez la grand-mère ou chez elle. La relation entre madame A et madame C (grand- mère paternelle) est positive. [ 4 ] Bien que ce soit difficile, les parties acceptent que les frères soient séparés.
Si les 2 garçons devaient être retournés avec leur mère, le risque d'échec serait trop grand. [ 5 ] Quant au père, il poursuit ses traitements par injection et est adéquat pendant les visites. Il voit ses enfants aux 2 semaines à AMCAL. [ 6 ] Madame A vit dans un appartement supervisé où elle reçoit du support psychosocial. Elle reçoit également l'aide d'une éducatrice du CROM qui la visite environ une fois par semaine. [ 7 ] Tous considèrent que madame A est capable d'assumer X.
FOR ALL THESE REASONS, THE COURT: [ 8 ] GRANTS the motion; [ 9 ] DECLARES that security and development of Y and X are still compromised; [ 10 ] ENTRUSTS the situation of the children to the Director of Youth Protection A, who shall then see that the measures are carried out: [ 11 ] ENTRUSTS Y to his paternal grandmother, C until his majority;
[ 12 ] ENTRUSTS X to his paternal grandmother, C until December 31, 2016; [ 13 ] ORDERS a reintegration process of X with his mother to start now; [ 14 ] ORDERS that the children's place of residence remain confidential in regards to the father; [ 15 ] ORDERS that contacts between the children and their father take place following modalities to be established by the Director at a frequency to be agreed upon between the parties, failing an agreement, the frequency will be once every 2 weeks; [ 16 ] ORDERS that contacts between the children and their maternal grandmother take place following modalities to be established by the Director at a frequency to be agreed upon between the parties; [ 17 ] TAKES ACT of mother's commitment to continue to participate with CROM services; [ 18 ] ORDERS that aid, counsel and assistance be provided to the children and their family; [ 19 ] THIS JUDGMENT for Y will be valid until his majority; [ 20 ] THIS JUDGMENT for X will be valid for one year .
