Article 38 de la Loi sur la protection de la jeunesse (L.R.Q. c. P-34.1) ______________________________________________________________________ Mise en garde : La
Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents. Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). [ 1 ] Le Tribunal confirme et motive, par le présent jugement, la décision rendue séance tenante lors de l'audience du 23 janvier 2015, conformément aux exigences de l’
article 90 de la
Loi sur la protection de la jeunesse . [ 2 ] La soussignée a remanié les motifs exprimés verbalement, pour en améliorer la présentation et la compréhension. [ 3 ] Le Tribunal doit déterminer si la sécurité et le développement de X sont compromis et le cas échéant, pour quels motifs. [ 4 ] La Directrice de la protection de la jeunesse soutient que la sécurité et le développement de l’enfant sont compromis en application de l’
article 38 b) 2 o de la
Loi sur la protection de la jeunesse . [ 5 ] Compte tenu du consentement des parties présentes à l’audience, le Tribunal déclare que la grand-mère maternelle, madame B, est maintenant
partie au dossier. [ 6 ] Les allégations de la requête sont les suivantes : “3.1 there is a serious risk that the mother is not providing for the child’s basic needs, more particularly but not restrictively in that:
a) the child was born premature at thirty-two (32) weeks;
b) the mother only realized that she was pregnant at 25 weeks of pregnancy;
c) the mother admitted consuming crack cocaine three (3) times per day;
d) the mother reported having stopped her consumption when she learned she was pregnant;
e) in 2002, the mother was diagnosed with paranoid schizophrenia;
f) the mother has been followed by the Douglas Hospital’s Psychiatry Department;
g) the mother lives a transient lifestyle;
h) since the child’s birth, the mother only visited the child once in the hospital;
i) the child has four (4) siblings and non are under the mother’s care;
j) the situation of the child’s siblings is known and followed by the Honorable Judge Dominique Wilhelmy;
k) the child was kept in the hospital until September 3, 2014;
l) on September 3, 2014, immediate measures were invoked and the child was entrusted to the maternal grandmother, Mrs. B;”. [ 7 ] La mère est absente à l’audience.
La situation telle que rapportée dans la requête semble être la reproduction de ce que le Tribunal a constaté concernant les autres enfants de madame A et telle qu’elle est décrite dans les décisions produites dans le présent dossier. [ 8 ] La mère n’est pas en mesure de prendre charge de son enfant, de la protéger et de répondre à ses besoins. [ 9 ] D’ailleurs la grand-mère maternelle a confirmé au Tribunal que la mère était dans un bien piètre état. [ 10 ] Le Tribunal n’aura donc aucune hésitation à déclarer compromis la sécurité et le développement de l’enfant. [ 11 ] Il est heureux de constater que la grand-mère maternelle désire continuer à prendre charge de cette enfant et envisage son implication à long terme. [ 12 ] Elle est en outre très triste de voir la situation la situation se trouve sa propre fille. [ 13 ] Après avoir reçu les admissions, pris en considération les témoignages, les rapports produits et la position des parties, le Tribunal conclut à l'existence de motifs sérieux de compromission en application de l’
article 38 b) 2 o de la
Loi sur la protection de la jeunesse et estime qu'il est dans l'intérêt de l’enfant et le respect de ses droits de rendre l'ordonnance qui suit. PAR CONSÉQUENT ET POUR CES MOTIFS, LE TRIBUNAL : [ 14 ] GRANTS the motion; [ 15 ] DECLARES that the security and the development of X are in danger (
section 38 b) 2 o of the Youth Protection Act ); [ 16 ] DECLARES Mrs. B as a party in the present file; [ 17 ] ORDERS that the child be entrusted to her maternal grandmother, Mrs. B; [ 18 ] TAKES JUDICIAL NOTICE that Mrs. B is being evaluated to become a foster family and in the eventuality that she is recognized as a foster family, ORDERS that the child be entrusted to the foster family of Mrs.
B; [ 19 ] ORDERS that frequency and modality of contacts between the child and her mother be determined by the Director of Youth Protection including supervision at all time; [ 20 ] WITHDRAWS from mother the exercise of the attributes of the parental authority and ENTRUSTS those attributes of the parental authority to Mrs.
B authorizing her to sign all consents pertaining to the child; [ 21 ] AUTHORIZES the Director of Youth Protection to obtain and share information with all the service providers working with the family; [ 22 ] RECOMMENDS mother to abstain from all mood altering substances unless prescribed by a doctor; [ 23 ] RECOMMENDS mother to complete a substance abuse treatment program and follow all of the recommendations made; [ 24 ] TAKES JUDICIAL NOTICE of the fact that the Director of Youth Protection intend that Mrs.
B be a tutor for the child; [ 25 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to the child and her family; [ 26 ] THE WHOLE for a period of one (1) year; [ 27 ] ENTRUSTS the situation of X to the Director of Youth Protection A, who shall then see that the measures are carried out; [ 28 ] This decision is enforceable from the moment it is made and any person referred to therein shall comply forthwith and notwithstanding an appeal ( Articles 93 and 105 of the Youth Protection Act ). __________________________________ DOMINIQUE WILHELMY, J.C.Q.
