Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The Director of Youth Protection requests the Tribunal to extend, for a maximum period of five (5) working days, the immediate protection measures for the child X, presently in the custody of a foster family. [ 2 ] The Tribunal recognizes the necessity to extend the immediate protection measures and the merits of the demand. [ 3 ] On the evidence, there is a serious risk of negligence on the part of the parents.

The father was intercepted by the police at night, walking down the street with the child in a stroller. He was severely intoxicated.

The child was partially naked under his coat. [ 4 ] The mother was at a friend’s house and was also severely intoxicated. [ 5 ] The parents have a conflictual relationship that can generate violence between them. [ 6 ] THEREFORE THE COURT : [ 7 ] GRANTS the demand; [ 8 ] EXTENDS the application of immediate protective measures for a period not exceeding five (5) working days; [ 9 ] ENTRUSTS the child to a foster family; [ 10 ] ORDERS that the visits between the child and his parents be supervised and without the presence of each other and accordingly to the modalities established by the delegate of the Director of Youth Protection; [ 11 ] ORDERS that the person authorised by the Director of Youth Protection provides aid, counsel and assistance to the child and

his family; [ 12 ] ENTRUSTS the situation of the child to the Director of Youth Protection who shall then see that the measures are carried out. __________________________________ MARIE PRATTE, J.Q.C.
