Section 95- 95.1 of the Youth Protection Act (L.R.Q., C. P-34.1 ) WARNING: The Youth Protection Act forbids the publishing or broadcasting of information allowing for a child or the child’s parents to be identified. Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] JD2620 The Court hereby confirms and provides written reasons for a decision rendered verbally at the hearing of August 29, 2014, in accordance with the requirements of
section 90 of the Youth Protection Act [1] . [ 2 ] The Court was presented with a motion for extension of an order rendered by the undersigned, on May 30, 2013, whereby the now two year-old child, X , was entrusted to her parents with aid, counsel and assistance, for a period of one year. [ 3 ] The facts alleged in support of the motion for extension dated May 14, 2014, are as follows: 3.1. the parents have fully participated in the court ordered measures, however, further services continue to be required; 3.2. in August 2013, the mother gave birth to baby Y who is followed under voluntary measures; 3.3. the parents are experiencing financial difficulties; 3.4. the parents continue to have arguments whereby the father is denigrating towards the mother; 3.5. the couple's relationship is fragile and the father has threatened to end the relationship; 3.6. the family has received intensive services, particularly from Youth Centre A and the CLSC, unfortunately CLSC services came to an end on May 1, 2014; 3.7. concerns continue to exist around the parents' ability to provide ongoing and consistent supervision for the child; 3.8. the parents minimize their own limitations and as a result, specialized services have not been accessed leaving the family in a vulnerable situation (reproduced with errors and/or omissions). [ 4 ] In light of the foregoing, the Director recommends that the child remain entrusted to her parents, with aid, counsel and assistance, as well as additional corrective measures, until February 28, 2015. [ 5 ] The parents, who chose to proceed without the assistance of legal counsel, admitted all the alleged facts and consented to the proposed measures.
[ 6 ] Me Fafard, on behalf of the child, made no admissions but approved of the measures proposed by the Director of Youth Protection. [ 7 ] The Director filed Exhibits D-1 and D-2 as evidence: D-1: Évaluation des capacities parentales dated October 11, 2013, signed by [Social Worker 2], under 294.1 C.p.c.; D-2: 95 Court report dated May 12, 2014, signed by [Social Worker 1]. [ 8 ] In
summary, the evidence establishes the facts alleged in support of the motion. [ 9 ] Moreover, the father's parental capacity assessment describes the challenges he faces and provides recommendations to assist him as effectively as possible. [ 10 ] As summarized in the conclusions of the assessment: Cet individu présente un fonctionnement intellectuel global se situant au niveau extrêmement bas. Hormis l'échelle du raisonnement perceptif se situant à la limite inférieure du niveau borderline, toutes les autres échelles affichent un fonctionnement au niveau extrêmement bas.
Ces limites intellectuelles affectent sa capacité de jugement, ses capacités de raisonnement, à résoudre des problèmes, à planifier ses actions en fonction d'un but, la capacité de percevoir des liens entre des choses et donc à généraliser d'un apprentissage dans une situation à une autre, la capacité d'apprentissage ainsi que d'apprendre à partir de l'expérience. Son fonctionnement est amélioré grâce à la présence de comportements adaptatifs qui seraient dans la moyenne selon l'évaluation de M. B. Cependant, il n'a pas été possible d'obtenir une évaluation externe d'un professionnel qui connaît bien M B.
Étant donné ceci, • Il est recommandé qu'une réévaluation des comportements adaptatifs soit effectuée. […] • Il est recommandé étant donné les résultats de diverses facettes du fonctionnement chez M B, autant intellectuel qu'affectif, que relativement à sa capacité de responsabilisation et d'insight, que le suivi se fasse à long-terme.
Bien que M B puisse paraître plus défensif, à un autre niveau il semble capable de s'engager dans un lien avec l'autre et c'est probablement via cette avenue qu'il peut être soutenu et aidé quant à ses capacités parentales. • Il est recommandé de poursuivre l'implication de l'éducateur de milieu et que l'apprentissage soit concret et orienté vers la résolution de problème; o Prendre un rôle plus engagé dans les soins donnés à ses enfants au quotidien; o Le sensibiliser quant à l'importance du développement du lien affectif avec ses enfants et l'aider à stimuler et à développer ce lien avec ses enfants. • Il est recommandé que M B soit engagé dans une intervention de gestion de la colère offerte dans un cadre qui maximise sa participation [2] (reproduced with errors and/or omissions). [ 11 ] Under the circumstances, given the evidence and the consent expressed by each of the parties, the Court is satisfied that the motion is well-founded and that the recommendations are in the child's interest.
THEREFORE, THE COURT: [ 12 ] GRANTS the motion; [ 13 ] DECLARES that the security and development of the child, X , remain compromised under the Youth Protection Act ; AS FOR THE MEASURES, THE COURT DEEMS IT TO BE IN THE CHILD'S INTEREST TO ORDER THE FOLLOWING MEASURES: [ 14 ] ORDERS that the child remain entrusted to the care of her parents; [ 15 ] ORDERS that the parents refrain from any form of verbal aggression or denigration in the presence of the child; [ 16 ] STRONGLY RECOMMENDS that the parents actively collaborate with suggested community services (e.g., couple counselling, co-parenting, parenting class); [ 17 ] ORDERS that the mother actively participate in individual counselling and follow the recommendations and TAKES JUDICIAL NOTICE of her agreement to do so; [ 18 ] STRONGLY RECOMMENDS that the father continue to actively participate in anger management counselling and follow the recommendations; [ 19 ] STRONGLY RECOMMENDS that the father follow the recommendations of his parental capacity assessment; [ 20 ] ORDERS that the parents ensure adequate supervision and maintain a safe home environment; [ 21 ] ORDERS that a person working for Youth Centres A provide aid, counsel and assistance to the child and her family; [ 22 ] ENTRUSTS the situation of the child, X , to the Director of Youth Protection A, who shall then see that the measures are
