[SOCIAL WORKER 1] Person authorized by the Director of Youth Protection Applicant and X Teenager and A Mother JUDGMENT WARNING: The Youth Protection Act forbids the publishing or broadcasting of information allowing for a child or the child’s parents to be identified.
Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The Tribunal is seized of a request for review and extension of the situation in regard to the teenager X (17 ½ years old) . [ 2 ] On December 10, 2019, the Court entrusts the teenager to B and orders, among other things, that the mother stays sober in the presence of the teenager and that the mother report periodically to the youth Protection social worker to inform them of their situation. [ 3 ] Since the last order, the teenager is entrusted to her maternal aunt’s, Mrs.
B. [ 4 ] In April 2020, the teenager became a mother. She frequents school every day and she is sober since she finished her therapy in December 2019. [ 5 ] The teenager and her son’s father are living together with her maternal aunt. [ 6 ] Her mother had drunk and drug problems during the last order. [ 7 ] The teenager is grateful to her aunt and her partner for their support and can count on them in the short to medium term. Her aunt is a positive role model for X . [ 8 ] As for her mother, her physical health worries those around her.
In fact, she has tuberculosis and was hospitalised for several months for an illness that affected her liver. [ 9 ] X and her aunt clearly have a significative bond between them. [ 10 ] The youngster has lived through difficult things since her childhood. She has repeatedly witnessed violence and abuse use from her mother and stepfather. She had to take care of her younger siblings while her mother and partner left home to use drugs.
She is a teenage girl who was parented as a child, who did not always consult with adults before making choices, and those choices weren't always right for her. [ 11 ] It is in her best interests to entrust her to her aunt B until she comes of age. [ 12 ] The Court concludes that the security and the development of the teenager remain in danger because she is a serious risk of
neglect. [ 13 ] The request, to which the parties consent, is in its interest and should be granted. FOR THESE REASONS, THE COURT: GRANTS the application; REVISES and EXTENDS the last order; DECLARES that the security and the development of the teenager remain in danger; ENTRUSTS the teenager to Mrs.
B until her majority; ORDERS that a person working for an institution or an organisation provides aid, counselling and assistance to the teenager and the teenager’s family for the same period; ORDERS that the mother stays sober in the presence of the teenager; ORDERS that the mother report periodically to the youth protection social worker to inform them of their situation; ORDERS to the teenager to attempt to school; WITHDRAWS parental authority from the mother and AUTHORISES the Director of Youth Protection or the person designed by her to consent to the health care and services needed, to the schooling and after-school activities, cultural and sports activities during the present order; ENTRUSTS the situation of the teenager to the Director of Youth Protection for the execution of the present order.
