ATTORNEY GENERAL OF QUEBEC RESPONDENT – Plaintiff JUDGMENT [ 1 ] This is an appeal of the judgment of the Superior Court, District of Montreal (the Honourable Madam Justice Katheryne A.

Desfossés), dated November 15, 2021, condemning the Appellant to pay the Respondent $97,328.06 plus interest and costs. [1] [ 2 ] The Appellant completed postsecondary studies in May 2004, at which time he was heavily indebted for student loans. In July 2011, he filed a voluntary assignment in bankruptcy. Then, in 2012, prior to his discharge from bankruptcy, the Appellant returned to his studies until 2015.

The Respondent, having reimbursed the financial institutions as guarantor of the Appellant’s obligations, was a creditor of the Appellant for the student loans in an amount exceeding $90,000 and contested the Appellant’s discharge from bankruptcy.

The Registrar nevertheless granted the discharge, conditional upon payment of $5,000, which the Appellant did pay. [2] The Registrar’s decision was confirmed by Morrison, J. of the Superior Court, [3] sitting in bankruptcy matters, in September 2017. [ 3 ] In August 2018, the Respondent instituted proceedings before the Superior Court seeking payment of the balance of the student loans, maintaining that the Appellant had not been discharged from this debt because seven years had not elapsed from the ultimate termination of the Appellant’s studies in 2015, the whole as provided pursuant to s. 178(1) (

g) of the Bankruptcy and Insolvency Act (“ BIA ”). [4] [ 4 ] The Superior Court judge, in the judgment under appeal, agreed and condemned the Appellant to pay the full amount. She applied the jurisprudence of this Court to the effect that in reckoning the period between the end of studies and the date of the bankruptcy, there is but one date of termination of studies, such that when a bankrupt returns to school, it is the most recent date which is used to start the seven-year clock under s. 178(1) (

g) BIA . [ 5 ] The judge did not retain the Appellant’s argument that the Respondent’s lawsuit was unfounded because the matter had become res judicata after the judgment of Morrison, J. dismissing the Respondent’s appeal of the Registrar’s judgment. The judge underlined that the Registrar had not explicitly dealt with the question of whether the Appellant had been discharged from the student loans, such that the doctrine of res judicata was not applicable. The Appellant has not raised a ground of appeal regarding this finding, which counsel described at the hearing as a strategic choice.

Consequently, the Court’s opinion is not required on this in order to dispose of the appeal, nor is it necessary, given the Court’s reading of s. 178(1) (

g) BIA . [ 6 ] In the Court’s opinion, the judge’s application of s. 178(1)(

g) BIA and her reading of the case law of the Court are tainted by an error of law. [ 7 ] Section 178(1) (

g) BIA provides as follows: 178

g) any debt or obligation in respect of a loan made under the Canada Student Loans Act , the Canada Student Financial Assistance Act or any enactment of a province that provides for loans or guarantees of loans to students where the date of bankruptcy of the bankrupt occurred (

i) before the date on which the bankrupt ceased to be a full- or part-time student, as the case may be, under the applicable Act or enactment, or (ii) within seven years after the date on which the bankrupt ceased to be a full- or part-time student;

titre de la Loi fédérale sur les prêts aux étudiants , de la Loi fédérale sur l’aide financière aux étudiants ou de toute loi provinciale relative aux prêts aux étudiants lorsque la faillite est survenue avant la date à laquelle le failli a cessé d’être un étudiant, à temps plein ou à temps partiel, au regard de la loi applicable, ou dans les sept ans suivant cette date; (Emphasis added) [ 8 ] The key date is the date of the bankruptcy, a term defined in s. 2 BIA and a notion central to bankruptcy law, which is used to reckon, inter alia , provable claims in bankruptcy [5] and to circumscribe various trustees’ recourses. [6] [ 9 ] In the judgments of the Court relied upon by the trial judge, the bankrupt resumed his studies before the date of his bankruptcy, which occurred less than seven years (or 10 years, prior to the amendment of the provision in 2007) after the date of the return to studies. [7] These cases need not be overruled but merely limited to their factual underpinnings.

By way of distinction, in the present case the Appellant returned to school after the date of the bankruptcy. As at the date of the bankruptcy (i.e., July 12, 2011) seven years had elapsed since the Appellant had completed his studies (in May 2004). The date of discharge from bankruptcy (September 28, 2016), though it is the moment when claims are, in law, released, [8] is not controlling, because under the clear wording of s. 178(1) (

g) BIA , the Appellant had been released from the debt to the Respondent given that seven years had elapsed between the completion of his studies and the date of the bankruptcy in 2011.

To simply state that this Court has decided that there is but one date of cessation of studies, [9] as the trial judge did, without reference to the factual context of the jurisprudence, is erroneous in law, particularly where her decision runs contrary to the clear wording of the enactment. [10] The single date of cessation of studies coined by the Court in this case law refers to the period of study (or its termination) occurring prior to the date of the bankruptcy. [ 10 ] In other words, in the English text, subparagraph (ii) of s. 178(1) (

g) BIA , which refers to a bankruptcy occurring within seven years of the debtor having ceased to be a student, must be read as at the date of the bankruptcy. Subparagraph (

i) of s. 178(1) (

g) covers the situation where the debtor is a student on the date of the bankruptcy. Both triggering events are to be read in relation to the date of the bankruptcy, not the date of the discharge. There is no contradiction between the English and the French texts although the drafting is structured differently. [ 11 ] Oddly, it appears from the judgment of Morrison, J. that this was the reading of the law proposed by the Respondent: [28] En réponse aux questions soulevées par le Tribunal, la Ministre et le Débiteur prennent la même position voulant que le principe de repousser la date de fin d’études pour avoir une seule date au sens de l’ article 178

(1) g) LFI devrait être limité aux faits existants au moment de la faillite. Autrement dit, la situation serait cristallisée au moment de la faillite. [ 12 ] Aside from running contrary to the plain wording of the statute, the judgment of the Superior Court leads to an incongruous result. Potentially (absent considerations of prescription), a debtor discharged from bankruptcy (where a student debt was a provable claim) could see that debt somehow revived because the debtor returned to studies several years later, notwithstanding the discharge.

The Respondent’s attorney, in answer to a question from the Court, maintained that such a debtor would be discharged because the return to studies occurred after the discharge. This arises from the Respondent’s reading of s. 178(1) (

g) BIA – i.e., a debtor is discharged from a student loan only if he returns to studies more than seven years after his discharge from bankruptcy. Such

interpretation underscores the need for the Court’s intervention. [ 13 ] Even if the Appellant was strategic or opportunistic in choosing when to file a voluntary assignment in bankruptcy, he is entitled to the benefit of the law correctly read and applied to his circumstances. If the legislature’s intention was not to allow bankrupts to benefit from such situations, it is for it and not the courts to intervene, given the clear language of s. 178(1) (

g) BIA . [ 14 ] The other arguments raised by the Appellant do not require comment. Nor is it necessary to adopt the “multiple date approach” reflected in the case law of some other provinces [11] where specific loans are tied to periods of study to determine whether they fall beyond the seven-year period. [ 15 ] Accordingly, the judgment should be reversed and the Respondent’s action in first instance dismissed with legal costs throughout. FOR THESE REASONS, THE COURT: [ 16 ] ALLOWS the appeal; [ 17 ] REVERSES the judgment of the Superior Court, District of Montreal (the Honourable Madam Justice Katheryne A. Desfossés), dated November 15, 2021;

[2] L’appelant a terminé ses études postsecondaires en mai 2004. Il était alors lourdement endetté compte tenu des prêts étudiants qu’il avait contractés. En juillet 2011, il a fait volontairement cession de ses biens. En 2012, avant d’être libéré de sa faillite, l’appelant est retourné aux études et y est demeuré jusqu’en 2015. L’intimé ayant remboursé les institutions financières à

titre de garant des obligations de l’appelant, il en était créancier pour un montant excédant 90 000 $ et s’est opposé à ce qu’il soit libéré de sa faillite. La registraire l’a néanmoins libéré, conditionnellement à ce qu’il paie 5 000 $, ce qu’il a fait [13] . En septembre 2017, la décision de la registraire a été confirmée par le juge Morrison de la Cour supérieure [14] siégeant en matière de faillite. [3] En août 2018, l’intimé a introduit des procédures judiciaires en Cour supérieure afin d’obtenir le paiement du solde des prêts étudiants, plaidant que l’appelant n’a pas été libéré de ces dettes puisqu’il ne s’est pas écoulé sept ans depuis la dernière fin de ses études

en 2015, tel qu’édicté par l’art. 178 (1)

g) de la

Loi sur la faillite et l’insolvabilité (« LFI ») [15] . [4] Dans le jugement faisant l’objet du pourvoi, la juge de la Cour supérieure s’est dite d’accord et a condamné l’appelant à payer le plein montant. Elle a appliqué la jurisprudence de la Cour voulant qu’il n’y ait qu’une seule date de fin d’études aux fins du calcul de la période comprise entre la fin des études et la date de la faillite, faisant en sorte que la date de fin d’études la plus récente soit utilisée comme point de départ de la période de sept ans prévue à l’ art. 178

(1) g) LFI lorsqu’un failli retourne aux études. [5] La juge n’a pas retenu la proposition de l’appelant voulant que la réclamation de l’intimé ne soit pas fondée puisque le sujet est devenu res judicata après le jugement du juge Morrison rejetant l’appel du jugement de la registraire. Soulignant que la registraire n’a pas expressément traité de la question de savoir si l’appelant a été libéré de ses prêts étudiants, la juge a conclu que la doctrine de la chose jugée ne pouvait s’appliquer.

L’appelant ne fait valoir aucun moyen d’appel à l’égard de cette conclusion, ce que son avocat décrit à l’audience comme un choix stratégique. Ainsi, l’opinion de la Cour sur cette question n’est pas requise pour trancher le pourvoi ni nécessaire compte tenu de la lecture qu’elle fait de l’ art. 178

(1) g) LFI . [6] La Cour est d’avis que la juge a commis une erreur de droit en appliquant l’art. 178

(1) g) LFI et en interprétant la jurisprudence de la Cour. [7] L’art. 178

(1) g) édicte ce qui suit : 178

i) before the date on which the bankrupt ceased to be a full- or part-time student, as the case may be, under the applicable Act or enactment, or (ii) within seven years after the date on which the bankrupt ceased to be a full- or part-time student; [Soulignement ajouté] [8] La date clé est la date de la faillite, une expression définie à l’article 2 LFI et une notion centrale au droit de la faillite, utilisée pour calculer, entre autres, les réclamations prouvables dans la faillite [16] ainsi que divers recours du syndic [17] . [9] Dans les jugements de la Cour sur lesquels s’appuie la juge d’instance, le failli a repris ses études avant la date de la faillite, qui survient moins de sept ans (10 ans avant que la disposition ne soit modifiée en 2007) après la date de ce retour aux études [18] .

Ces arrêts ne doivent pas être renversés, mais simplement limités en fonction de leur fondement factuel. En l’espèce, la distinction tient au fait que l’appelant est retourné aux études après la date de la faillite. À la date de la faillite (soit le 12 juillet 2011) sept années s’étaient écoulées depuis la fin de ses études (en mai 2004). La date où il fut libéré de sa faillite (le 28 septembre 2016), quoique constituant le moment où le failli est, en droit, libéré des réclamations [19] , n’est pas déterminante, car le texte clair de l’ art.178

(1) g) LFI fait en sorte que l’appelant est libéré de sa dette envers l’intimé puisque sept ans se sont écoulés entre la fin de ses études et la date de sa faillite en 2011. D’affirmer simplement, comme l’a fait la juge d’instance, que la Cour a décidé qu’il ne peut y avoir qu’une seule date de fin d’études [20] , sans égard au contexte factuel de la jurisprudence, est une erreur en droit, particulièrement lorsque sa décision est contraire au texte clair de la disposition [21] .

La date unique de fin des études utilisée par la Cour dans ces affaires réfère à la période d’études (ou à sa cessation) qui survient avant la date de la faillite. [10] Dit autrement, dans le texte anglais, le sous-paragraphe (ii) de l’art. 178

(1) g) LFI , qui réfère à une faillite survenant dans les sept ans suivant la date où le débiteur cesse d’être étudiant, doit être lu comme à la date de la faillite. Le sous-paragraphe (

i) de l’art. 178 (1)

g) LFI , toujours dans le texte anglais, vise la situation où le débiteur est étudiant à la date de la faillite. Ces deux événements déclencheurs doivent être lus en regard de la date de la faillite et non de la date de libération. Il n’y a pas de contradiction entre les versions anglaise et française, même si leur structure diffère. [11] Curieusement, il appert du jugement du juge Morrison qu’il s’agissait là de la façon que l’intimé proposait de lire le droit : [28] En réponse aux questions soulevées par le Tribunal, la Ministre et le Débiteur prennent la même position voulant que le principe de repousser la date de fin d’études pour avoir une seule date au sens de l’ article 178

(1) g) LFI devrait être limité aux faits existants au moment de la faillite. Autrement dit, la situation serait cristallisée au moment de la faillite. [12] Hormis le fait qu’il est contraire au texte clair de la loi, le jugement de la Cour supérieure mène à un résultat incongru.

Potentiellement (et abstraction faite de toute question de prescription), un débiteur libéré d’une faillite (dans le cadre de laquelle une dette étudiante était une réclamation prouvable) pourrait voir cette dette renaître, malgré sa libération, s’il retournait aux études quelques années plus tard. Questionné par la Cour, l’avocat de l’intimé soutient qu’un tel débiteur serait libéré puisque le retour aux études serait survenu après la libération. Cette proposition découle de la lecture que l’intimé fait de l’ art. 178

(1) g) LFI – c’est-à-dire qu’un débiteur n’est libéré d’un prêt étudiant que s’il retourne aux études plus de sept ans après avoir été libéré de sa faillite. Cette interprétation démontre qu’il est nécessaire que la Cour intervienne. [13] Même si l’appelant a usé de stratégie ou a été opportuniste en choisissant à quel moment faire volontairement cession de ses biens, il a droit au bénéfice de la loi correctement interprétée et appliquée aux circonstances de l’espèce. Si l’intention du législateur n’était pas de permettre aux faillis de bénéficier de telles situations, il lui appartient, et non pas aux tribunaux, d’intervenir vu le texte clair de l’ art. 178

(1) g) LFI . [14] Les autres arguments de l’appelant ne requièrent pas de commentaires. Il n’est pas non plus nécessaire d’adopter l’« approche des dates multiples », reflétée dans la jurisprudence de certaines autres provinces [22] pour déterminer si des prêts spécifiques liés à des périodes d’études se situent à l’extérieur de la période de sept ans. [15] Ainsi, le jugement doit être infirmé et l’action introduite par l’intimé en première instance doit être rejetée avec les frais de justice tant en première instance qu’en appel. POUR CES MOTIFS, LA COUR : [16] ACCUEILLE l’appel; [17] INFIRME le jugement de la Cour supérieure, district de Montréal (l’honorable Katheryne A. Desfossé
