Date of Judgment: December 15, 2015 [ 1 ] It has come to my attention that there is a significant error in my reasons for judgment on the trial and delay application cited at R. v. Dougan, 2015 BCPC 279 and 280. I incorrectly found that Trevor Castagner served a prison sentence for his conviction. The evidence and submissions taken at trial should not have led to this finding about the sentence Mr. Castagner received.

My decisions are not impacted by this correction. [ 2 ] Accordingly, the last two sentences of paragraph 11 of 2015 BCPC 279 will be amended to read as follows: Additionally, another witness, the one who found the location of the site in Yukon where the Crown believed the sheep was shot, was not called as a witness. That evidence is lost. [ 3 ] Paragraph 21 of 2015 BCPC 280 will be amended to remove the sentence “He is serving federal prison time.” ____________________________ S.D. Frame Provincial Court Judge
