RICHARD VALLIÈRES RESPONDENTS – défendeurs ORDER to safeguard the rights of the parties ( C.C.P. , a. 46) [ [1] ] [ 1 ] On April 16, 2013, Respondents, 657807 New Brunswick Inc. and Richard Vallières, obtained a judgment against Respondent Abbas Sheikh in the Québec Superior Court in the amount of CAD $ 888,925.45. [ 2 ] The Appellant, Fédération des producteurs acéricoles du Québec, has challenged this judgment before the Québec Superior Court. [ 3 ] On January 24, 2014, the Québec Superior Court denied its motion to stay judgment pending the challenge. [ 4 ] Today, a judge of this Court granted leave to appeal from this second judgment of the Québec Superior Court (dated January 24, 2014). [ 5 ] The appeal is now pending. [ 6 ] The Appellant asks the Court to stay the first judgement, of April 16, 2013. [ 7 ] Fraus omnia corrumpit . [ 8 ] The allegations of fraud and collusion between the Respondents are serious.
Documents and dates of transactions between the Respondents give weight to these allegations. The appeal is prima facie well founded. [ 9 ] An immediate stay of proceedings and suspension of execution of the judgment of April 16, 2013 is necessary to prevent a denial of justice. [ 10 ] Pending criminal charges against Respondent Vallières and the past criminal record of Respondent Sheikh strengthen the allegations of the Appellant. [ 11 ] The Appellant is a well known and solvent public organisation.
There will be no order to furnish security. [ 12 ] The present judgment is enforceable immediately. [ 13 ] FOR THESE REASONS, THE COURT : [ 14 ] GRANTS the stay of proceedings and suspends the execution of the judgment rendered on April 16, 2013, file no. 200-17- 017806-134 of Québec Superior Court;
[ 15 ] ORDERS the Respondents to cease any proceedings concerning the execution of the judgement rendered on April 16, 2013; [ 16 ] ORDERS the Respondents to transmit the present order to any person to whom they presented, and will present, the judgment of April 16, 2013, particularly to the honourable Vermont Superior Court, Civil division, of Orleans County, Vermont, U.S.A.
