Justice Martineau BETWEEN: HAMMED ALABI ABODERIN Applicant and THE MINISTER OF CITIZENSHIP AND IMMIGRATION Respondent ORDER [ 1 ] The applicant seeks a stay of his scheduled removal to Nigeria, which is set for June 5, 2018, until such time as his application to set aside the negative pre-removal risk assessment [PRRA] decision has been decided by the Court. [ 2 ] Having read the motion records of the parties and heard their counsels by telephone conference call, I am not satisfied that a serious issue has been raised by the applicant, nor that irreparable harm will result from the removal.
An outstanding leave and judicial review application does not create a right to remain in Canada. Despite the low threshold, the applicant has not raised any particular ground of attack against the PRRA decision. Speculative allegations of risk are not sufficient evidence of irreparable harm. Accordingly, the balance of convenience favours the respondent. THIS COURT ORDERS that the motion for stay be dismissed. “Luc Martineau” Judge
