California Rules of Court — Rule 1 — Unlawful deta iners 4 5 (a) Application 6 7 Notwithstanding any other law, including Code of Civil Procedure sections 1166, 8 1167, 1169, and 1170.5, this rule applies to all actions for unlawful detainer. 9 10 (b) Issuance of s ummons 11 12 A court may not issue a summons on a complaint for unlawful detainer unless the 13 court finds, in its discretion and on the record, that the action is necessary to protect 14 public health and safety. 15 16 (c) Entry of default 17 18 A court may not enter a default or a default judgment for restitution in an unlawful 19 detainer action for failure of defendant to appear unless the court finds both of the 20 following: 21 22 (1) The action is necessary to protect public health and safety; and 23 24 (2) The defendant has not appeared in the action within the time provided by 25 law, including by any applicable executive order. 26 27 (d) Time for trial 28 29 If a defendant has appeared in the action, the court may not set a trial date earlier 30 than 60 days after a request for trial is made unless the court finds that an earlier 31 trial date is necessary to protect public health and safety.
