THE COURT (MORSELL, Circuit Judge, absent, and THRUSTON, Circuit Judge, doubting) told the jury that in law the goods stolen were the goods of the husband, and ought to have been so stated in the indictment. Verdict not guilty. The prisoner was remanded.
