Ouellette Ministre des Richesses naturelles Projet de loi du gouvernement 1 re lecture 12 décembre 2002 2 e lecture 3 e lecture Sanct ion royale Imprimé par l’Assemblée législative de l’Ontario EXPLANATORY NOTE NOTE EXPLICATIVE The Bill establishes a recreation reserve in the Kawartha Highlands. The lands comprised in the recreation reserve are to be described in the regulations but shall not include any lands that are excluded under subsection 2 (3). Le projet de loi crée une réserve récréative dans les Kawar- tha Highlands. Les biens-fonds co mpris dans la réserve récréa- tive sont décrits dans les règlemen ts mais ne doivent pas inclure les biens-fonds qui sont exclus en vertu du paragraphe 2 (3). A recreation reserve is to be used for recreational activities such as hunting and fishing, canoeing and snowmobiling and fo r non-industrial commercial activities such as commercial fu r harvesting and guided hunting. Areas in the reserve may be defined by the Minister and set aside for particular recreational or commercial activities. Industrial activities are prohibited in a recreation reserve. Une réserve récréative est util isée pour des activités récréa- tives telles que la chasse et la pêche, le canotage et la motoneige et pour des activités commerciales non-industrielles telles que la chasse commerciale des fourrures et la chasse guidée. Le mi- nistre peut délimiter des zones de la réserve et les réserver à des activités récréatives ou commerciales précises. Les activités industrielles sont interdites dans une réserve récréative. The prohibition applies to permit applications made on or afte r January 1, 2010. Le projet de loi modifie la Loi de 1992 sur le code du bâtimen t afin d’interdire au chef du service du bâtiment de délivrer un permis de construire un bâtimen t si le bâtiment projeté com- prend un garage de remisage ou est desservi par un tel garage, mais ne comprend pas de réseau de récupération des eaux plu- viales. L’interdiction s’applique aux demandes de permis faites le 1er janvier 2010 ou par la suite. Le projet de loi a pour objet de rétablir les dispositions qui on t été intégrées dans la Loi sur les relations de travail par la Loi de 1992 modifiant des lois en ce qui a trait aux relations de travai l et à l’emploi et qui ont été abrogées par la suite par la Loi de 1995 sur les relations de travail. The purpose of the provisions being restored is to prevent a n employer from replacing striking or locked-out employees with “replacement workers”, a term that is defined in the Bill. The Bill allows replacement workers to be used in emergencies. Le fait de rétablir ces dispos itions a pour but d’empêcher un employeur de remplacer des employés qui sont en grève ou e n lock-out par des «travailleurs suppléants», terme qui est défini dans le projet de loi. Le projet de loi permet toutefois l’utilisa- tion de travailleurs suppléants dans des cas d’urgence. Le projet de loi modifie la Loi de 1995 sur les relations de tra- vail afin d’y ajouter un article prévoyant que, lorsque l’em- ployeur transfère à un autre endroit ou à un employeur lié des travaux effectués par des employés représentés par un agent négociateur, les employés qui effectuent les travaux transférés sont réputés compris dans la même unité de négociation, à condition qu’ils ne soient pas déjà représentés par un agent né- gociateur.
